Off sick - Bank Hols in lieu?

Post by Glyno »

I asked my union rep a question today that he couldn't answer with any degree of certainty  ...

I'm going into hospital in mid December for an op and expect to be off sick for about a month thereafter (ie - returning to work mid Jan). The thing is, will I forfeit the three bank holidays (xmas day, boxing day & new years day) that'll fall within my period of absence or will they be 'owed' to me and added to my holiday allowance - in lieu as such?

Thanks in advance

This is actually a bit of a grey area as Royal Mail now use bank holidays to make up part of your statutory holiday entitlement of 28 days....so if you're up for a fight. :whistle

if a bank holiday falls during your sick leave you lose it! if your holiday does you get it back i've been there, it's the same for most companies.

If I ran a company and an employee who i have been paying full pay too, wanted lieu days because his sick fell on a bank holiday I dont think i would be to impressed....

Would you ?.....

The point is if in the unlikely event you were off sick for the entire year you would legally accrue 28 days leave not the minimum 23 1/2 days that RM give you for your annual leave.
So...you could argue that at least SOME of the Bank Holidays are part of your statutory leave and cannot be denied to you.
As i said it's a grey area and would take some courage to pursue as a test case.

Bank Holidays have nothing to do with annual leave allocation...

Its 4 weeks 3 and a half days leading to 6 weeks after 20 years ..You can 'purchase' extra holidays..

Bank and Public holidays are on top of that...

Yes but the LEGAL MINIMUM is 28 days or 5.6 weeks for a five day week so without the Bank Holidays Royal Mail are in breach of Working Time Regulations 1998.

New starters 23.5 days plus bank/public holidays of 9 days( eng and wales).....

Sick pay is a entitlement NOT a right..New starters and most firms do not have the generous sick pay provisions we have...
