I asked my union rep a question today that he couldn't answer with any degree of certainty ...
I'm going into hospital in mid December for an op and expect to be off sick for about a month thereafter (ie - returning to work mid Jan). The thing is, will I forfeit the three bank holidays (xmas day, boxing day & new years day) that'll fall within my period of absence or will they be 'owed' to me and added to my holiday allowance - in lieu as such?

No chance..They will be included on your sick record the same as sundays are....

No chance..They will be included on your sick record the same as sundays are....

The OP is still entitled to the same holidays as others
If your on the sick you cannot claim public holidays back...No chance im afraid...... if your on leave however you can..Also,if you have leave booked while on sick obviously you claim your leave back..
This is actually a bit of a grey area as Royal Mail now use bank holidays to make up part of your statutory holiday entitlement of 28 days....so if you're up for a fight.

If I ran a company and an employee who i have been paying full pay too, wanted lieu days because his sick fell on a bank holiday I dont think i would be to impressed....
The point is if in the unlikely event you were off sick for the entire year you would legally accrue 28 days leave not the minimum 23 1/2 days that RM give you for your annual leave.
So...you could argue that at least SOME of the Bank Holidays are part of your statutory leave and cannot be denied to you.
As i said it's a grey area and would take some courage to pursue as a test case.

Yes but the LEGAL MINIMUM is 28 days or 5.6 weeks for a five day week so without the Bank Holidays Royal Mail are in breach of Working Time Regulations 1998.

yes I was told this too. was finished on ihr a week ago and I said about the bank hols they owed and was told you dont get bank hols back when off on sick.
