Can ATOS force you to take ill health with lump sum?
Have long term health problem.Seen EHS and now ATOS over the the years.Been offered IHR with lump sum(can not afford to take).Due to see ATOS again and am worried that they may be able to push me to to take it.IHR with pension would consider.Do i have a say if they get shirty?

they only recommend. it's your lino that makes the decision to [sack] ill health retire you.
you will have the choice - (1)with lump sum or (2)immediate pension
if you take pension - you cannot work for approximately 10 years minimum, but with lump sum - i think it's 9 months before you can look for work again.
you would be assessed by DWP for benefits but the way things are going - that could be iffy !?

I repeat what I have said before.. It is utter nonsense to suggest you CANNOT work for 9 months or 10 years.. Those are the numbers the Doctor will use in determine what if any IHR to recommend to the Company...
There is nothing stopping you working again whenever you like...
Most occasions the Company will accept the Doctors recommendations . You can appeal IHR and you will need Medical Evidence ( the Company will cover the cost ) but it is not easy...

Stay off for as long as possible,don't accept the ill health pay off and start claiming Employment and support allowance,the DWP will send for you to have a medical with ....ATOS...WHEN not IF they find you fit for work you can ask for the medical report.....
If they have already tried to pay you off or given you notice...appeal,get the union to arrange another face to face with an Atos doctor sometimes your lino or DOM will think of doing it again just to be sure they can ill health retire you......then go with your DWP medical report and when the RM Atos appointed quack starts bleating on about ill health retirement blah blah blah then hand over your DWP report saying how you are FIT to work and be A BLE TO DO SOME WORK.......stand back and watch them squirm and have to go out of the room and ring HQ up for advice.

Employment and Support Allowance offers you personalised support and financial help, so that you can do appropriate work, if you are able to.

Permitted work
It's possible to keep your ESA while doing some part-time work called permitted work. There are various forms of permitted work, but generally you may only work fewer than 16 hours a week, and you can't earn more than £93 a week.

The post said I was referring to mentioned that refusing a pay off and still employed by RM and then claim ESA... That was I was calling rubbish...

I have just re read my links posted above and the way I read it is that you can continue to work and claim ESA as long as you meet the requirements. As to refusing the pay off not sure how that would affect it ESA as I thought that the IHR pay out was discretionary so if you think its not fair you can refuse and continue working till there is an agreement.
I may be wrong though as I was just investigating the ESA stuff, and the IHR is just what I have picked up from RMC.

Last year RM tried to ill health retire me,I refused as the pay off was s**t and thought I should have been offered indoor work, I was not getting any pay off RM as I had used up all of my sick related pay so I went to the Jobcentre and was told to go onto Employment and Support allowance by one of their advisors(also HR sent me a letter to do so!
I was still on Royal Mails books...(I even had to attend job based interviews with the Shaw Trust
Or did I just dream it all??????

IHR with Pension does not come with a lump sum at all... You can take UPTO 25% of your Pension Pot in a Tax Free lump sum if you wish for a smaller monthly pension....
The reason it is rarely offered ( wheres your evidence for that ? ) is that you have to be unable to work for 10 years at the OPINION of the Doctor employed by the Company...

You didnt make that clear in your first post ..Working for RM while Collecting ESA suggested that you were also getting paid off RM every week...
