Under the rules if you dont have back to work interview is the absence off the radar i.e not registered and therefore not counted towards stage?

No...your absence is now in the system.
The system decides when you've triggered the stage....it cares not whether you've had a RTW interview.

And even worse i believe if you get a stage warning then it's taken from the day you're issued with it, not the last day of sickness.

The computer will trigger the stage, but if you dont have a back to work for any reason for any previous absences then you can fight your stage as the managers haven't followed the proceedure.

I've successfully challenged the date of stage warning to be back dated to the return to work day, rather than the date the warning was issued, sometimes weeks after returning to work.......get your rep to do the same.
