1-0 to me & advice please

Hi all,

Last week i had to make a visit to the doctors (after my shift) and was told i needed to be off sick for a couple of weeks, well i figured since i'm only part time and already on a stage 1 warning it would make more sense to go on light duties...so, as soon as i got home i let my dom know...i said i dont mind covering the callers office or doing sorting (anything that doesnt include driving, walking or heavy lifting) anyhow i left that part up to them.. after all he's the dom not me. So for the first 2 days i was in the caller office, which was ok. By day 3 i was asked to go out and finish delivering what was left from 2 deliveries....i very kindly declined stating i couldnt walk that far and also they had paid someone 2.5 hours o/t the day before to do the same thing. I also want to point out that on the first day of my light duties i was made to fill out a form to ATOS. after i declined the work i was told if i couldnt do that i should go home........so i did. I spoke to my union rep who in a way kind of fobbed me off until i shut up, i explained that i wanted to start a grievence procedure as i felt bullied and made to feel a s**t of the brown stuff!!!! he didnt seem that keen.

Yesterday i got a phone call from my dom asking when im going to be back in work, i stated that it was them who sent me home and that i would be waiting until i spoke to ATOS and no decision would be made until then.

Anyhow i had my obligatory call from ATOS today, and it went rather well, as soon as i explained to them what it was, they made a decision that i couldnt be on a drving duty, a delivery and not lift anything....in fact the only thing they suggested was i could do light sorting or go in the caller office............after the phone call i was chuffed to bits as it felt that my dom has now fallen flat on his face.

the only thing that bothers me now is that i feel my dom will try and make my life s**t, and would like some advice from you bunch .
* do i have a case for bullying in the first place (due to being referred to ATOS after 1 day on light duties & them being sent home)
* will i now qualify for a second stage warning even though i was sent home by them??
*is there anything i can do to prevent the s****y situation i will walk back into

The fact that they sent you home counts in your favour. If it does end up in a stage 2, I would say appeal but not to worry too much about it. If it gets to a stage 3, then you have the fact that you were sent home in your favour. You were willing to work, wanting to work, gave them options to enable you to stay at work and your DOM declined.

You could put in a grievance but, if you've got to go work back at that office, I personally wouldn't. I would, however, keep a note/diary of everything that happens in case you need to in the future.

thanks for the advice, i have kept a diary of everything that has happened either directly or not to me, so this one is defo in it. I feel that attitude i will get will be negative as he is just that way out, and because he couldnt be arsed even googling the type of injury and he didnt know how much pain i was in, and therefore just referred me to ATOS out of spite (i.e without knowing if it a short term or long term thing), no-one else gets this treatment...I must point out that i do loads of o/t for them and usually work 6 full days out of the 7, so now i wont be doing that!!!! I mean the way i was spoken to and treated after 1 day of light duties really quite shocked me and figure that this treatment will carry on when i go back in

What did you get a stage one for? It might have some bearing on how they treat you.

Had to have a week off when a had swine flu, then another week off when i broke a bone in my foot, it finishes in october this year though, so nearly done the year without any further sick leave, cant see that being an issue really but maybe!!!

Feck the stage 1 take the amount of time off your doctor has told you to and take a stage 2 simples.

Is your health not more important than stages ,I know it can be worrying facing any stage warning but in the long run it will benefit you to take the time off to recoup your doctor has advised you to take.

Feck R/M there stage warnings are mechanistic and a complete joke.

Before you returned to work your ATOS report should of been in place ,have you received your report yet.

Dont let R/M bully you back to work if your not fit in the eyes of your quack who are R/M to say your fit to return to duty.

Had my ATOS phone call interview yesterday and they said they would pass it onto to dom asap, so,im due another phone call from work to ask if im in on monday, im hoping that ATOS get back to them today so they sort something out for me.....if not i wont be going in until it has !!!!!!!

i used to be the sort of postie that would go into work whatever and whenever, nothing would stop me, but now i guess ive finally learnt what a bunch of simple minded idiots they are....where do they get them from, is there a special school they go to and find them, and train them up to be like it??

TM1 once your DOM has your ATOS report make sure you go in with rep as R/M can not be trusted.

Isnt it a shame R/M dont take into account your past work history and show a bit of common sense when issuing stages,and it is because of this i say its mechanistic.

Just be careful buddy as R/M as you are aware will try anything to get you back on delivery whether your fit to return or not.

Just a quick update, had my phone call asking when im going to be back in and suprise suprise they tried to ignore everything in the ATOS report and make me go back my my normal delivery...........i argued the point and told them i know what was in the report and i know what they said i could do. finally after 10 minutes they backed down and gave in...why is it so difficult for them to understand, it was them who tried to stitch me up and get ATOS involved in the first place. i got a feeling though that through all this it give me more of a case when i really need it, and maybe even a bout of leave due to stress at work!!!!!!!!!!!!!LOL

RM don't have to take ATOS recommendations, it is only advice. Well thats what I was told and the managers like to use the term 'Operational Reasons', so expect that one to come into play within a week of your return.

I know its a load of bollox Postman but they arn't taking any notice. I'm back on a full duty albeit not a difficult one, even though I was told max 1 hour walking with a trolley, thats not happening. Rep is on leave and when he is about he's in the office doing the revision Re-referred loads of us back to Atos. I'm off to my see my GP in a couple of days, get my own fit note the DOM will have to listen to that but I won't hold my breath.

TM1 put in a grievance mate they do this because all D/Os are being whittled down to the bear bones.

They do not have enough staff to cover days off let alone sickness.

Management now are hell bent on us lapsing regardless of staff shortages and mail volumes.

You were warned what R/Ms response would be now get ready for there 2nd assault on you ,as they will turn the thumbs screws that little bit more to try and get you to return to duty.

Until you return to full duty every phone call you receive log it all letters keep and most importantly all interviews take in your rep.

I agree. ATOS can only make a 'recommendation'. ATOS told me themselves. I was in a position where I had two ATOS medical reports. Both made specific stipulations to my work content. I asked ATOS as to why no action was being taken after first report - they told me RM don't have to adhere to it.

But, should things worsen - you have 'em bang to rights.
