Stage warning - Advice needed

Ok here goes.

I had corrective surgery in Feb 2009 on my leg. As I was already on a Stage 1 I knew this time off would trigger a Stage 2.

Upon my return to work in April 2009, a Stage 2 interview was conducted by my dom with myself and my union rep present. I fully expected it to be awarded despite everything that is said in the Sawyer Report, etc.

Heres the thing, I was NEVER summoned back in for the outcome. So I let it ride and said nothing.

Ive just phoned HR with an address change, and decided to enquire about my stage warning status. I was informed that a Stage 2 was issued on Oct 5th 2009, almost 6 months after the interview and without my knowledge.

Obviously I want to challenge this, but would like advice on how to go about it. I know we cant appeal against stage warnings, but as my dom has failed to follow procedures (and has since left our office) Im not going to take this lying down.

Your thoughts and advice please. Our rep is off sick at present and unavailable for guidance.

If you feel the correct procedures haven't been followed or you feel you have been treat unfairly you can put a grievance form in against the person who issued it if you so wish.

You've got the c*** bang to rights,if you accept the stage 2,which tbf you have no choice it should be backdated to say a week after you returned to work,April 09.
Technically you are still on a stage warning (till oct 2010)because of the date f**k up so you should get this sorted as if you go from April 09 you should be off it.
I would put a grievance in,these guys take the piss.

Ill accept the stage 2 if its backdated, I was expecting that anyway. But the underhand way its been done, almost as an afterthought really, has boiled my water.

How do I go about putting a grievence in then??


Coincidentally, I had to have the other leg operated on in July 2009. My return to work in Sept 2009 should have then triggered stage 3. I bet thats when he realised he hadnt completed the stage 2 correctly and processed it without my knowledge

Wait for your rep to come back or see your current manager for a form.

I was led to believe that if the warning is not issued within one month of your return to work then it's invalid. Could be wrong but worth checking out!

The interview and whatever is supposed to be within a 'reasonable' time frame.
What is 'reasonable' to us is no doubt much different to them cruds.

you should be consulted at all stages of this proceedure, and advised of the outcome. If you had not been told it had been issued, you have a fair shout.go get 'em.

I'm due an op on my knee in the next few weeks (hopefully). Saw my DOM this morning regarding this and he said the op will trigger another Stage I have already had a Stage 3 interview for the bloody injury, so looks like I'm going to get another. All this crap I have to deal with for an AOD, makes me so Managers are also not adhering to the ATOS recommendations, they say ATOS report is too vague and I need to do a whole duty for operational reasons. You just can't win with this company.

Get a copy of your ATOS report. Regardless of what they may say, you are entitled to one.If all this is down to an accident at work, then simply refuse to sign and accept a stage 3! This has worked in our office on occasion.

We argued as id had corrective surgery to remedy the STAGE 1 they couldnt issue it

Got area rep involved

Yes, this has been argued in our office too, let your DOM know this,it will make him think twice.

I had an AOD, my knee as well. I have now had 3 ops, 18 hospital appointments, 2 private examinations set up by the solicitor, plus 8 physiotherapy appointments and about 20 lower limb class appointments.
I have had god knows how much time off for all this and because it was an AOD i haven't even been given a stage 1. After the first spell of time off i had an interview for a stage 1 with the Area Rep present and between him me and the manager we agreed as it was an AOD no action would be taken, so all this has been going on for the last 2 and a half years and i still have no stages.So my question is what are the Reps doing letting your Dom get away with this, it's not right and it's not fair that you should have to put up with it when you are just trying to get fit again. I think I'm going to have to get onto the Area Rep. I'm getting constant grief off the LM's, bitchy little comments. This morning I felt like telling them I was going home sick. My knee is giving me so much pain but can't take the painkillers I've been prescribed before work otherwise I'd end up crashing the van. Got a phone appointment with my GP tomorrow, hoping he gives me a fit note that RM will have to adhere to. I know that if I get another stage I'm out of the door irrelevant of whats wrong with me, I was told that on my last Stage interview.
