Bank Holiday and Lose your Day off.

Heard a rumour in my office Today that RM are trying to get the union to agree if it's your day off and it falls on a bank holiday they are not going to owe you a day,they are supposed to be trying this from next April,it's only a rumour but you never know.

Doubt it,
By doing this a few people unlucky to have the day off on a bank holiday would end up working five days while the rest only had to do 4 for the same money.

I doubt it also as the Directgov website has this little snippet:

If you are part time and your employer gives workers additional time off on bank holidays, this should be given pro rata to you as well, even if the bank holiday does not fall on your usual work day.

My reading would be that they have to either pay you for the day off or give you a day off in lieu.

Also as the 8 days PH in England are part of your minimum entitlement to paid holiday they would have to increase our annual leave to make sure they met the minimum legal requirements. At the moment the minimum amount is 28 days and RM give us 4 x 5 days + 8 days PH (making 28) if they removed the 8 days PH entitlement by not paying it or by giving it in lieu then they would have to increase the basic entitlement to reflect it.

Ergo no change IMHO.

It was last xmas, they got away with it as Saturday was not classed as BH, the monday was classed as BH instead of Saturday. RML in their genroisty gave us Saturday off as they were allowed by the regulator to class the Saturday as no service day. You do not get a day back for non service days only for offical BH, something for CWU to tackle!

It was last Christmas - a Saturday which RM gave everyone off but without a "in lieu" entitlement for those that had Saturday off anyway. They got away with this as the Saturday was not the "Official Bank Holiday" Monday was so there was no legal entitlement to having Saturday off - they could have made everyone due to work come in and there would have been FA we could have done about it. Although the vote in March may have been affected by such a decision.

Not that I'm trying to wish my life away or anything, but does anyone know what the crack is this year for Xmas and New Year bank holidays? According to my diary Saturday 25th is Christmas Day, so we should get that off no problem. But then with Boxing Day being on the Sunday and Xmas day being on the Saturday, it looks like we should get Monday 27th and Tuesday 28th in lieu. As I said, thi is all according to my diary, and as much as I would wish it, I can't see RM giving us Monday AND Tuesday off. Also, New Years Day is on a Saturday- so shouldn't that mean Monday off as a day in lieu? Fingers crossed, but I ain't holding my breath.

Substitute day means instead of because the original is on A Saturday or Sunday.

I don't think so.
If they follow last years model Saturday will be a "no-service" day and Mon and Tues will be the bank holidays.
So you will only get Mon back.

i dont really bother wasting my time on this anymore. last august my day fell off on a bank holiday. or around then, maybe earlier. and just today, i got that day back after over 1 year of nagging!!!! hurray!!!

Not sure if this is the same across the country (whatever is nowadays?) but we were told by our manager that days owed for bank holidays could not be taken until the following financial year. Anyone else get this? I suspect it has more to do with hoping that people will forget than any official policy.

Not up here...not if it was annual leave anyway,you get that back the same year.
Day off was different though...it goes into next year.
