Average holiday pay.

Right sp im on leave this week so i'll be dropping down to my pitiful 20 hour contract. I rang HR services to see if i will recieve an average of my last 12 weeks pay while i'm on leave, and was pretty much laughed at on the phone. Can anyone clarify what the legal position is over this. Is it me expecting too much of RM doing as they please yet again?

I'm no expert but I would say you'll only get the 20 hours you're contracted to work because it says:

Pay for non contractual overtime is excluded.

So unless the overtime is in your contract you'll only be paid your basic contracted hours.

Unless someone takes RM to a tribunal then you'll never know, it would also be interesting to see if they could get away with it because the duties being covered are longer then the contracted hours.

Yep i got that one too,but 1hr,10hr,20hr,you get my drift.
But i'm sure HR agreed someone who was not on a 1hr contract would get average pay.Or is it my age.

I remember that too but then I could also be going a bit senile it's that bloody naughty room

Whitemoor 66, if that helps judicial adjudication and repayment of holiday and pension entitlement due to Working regular excess over and above contracted hours. IE he took the pickpockets to court and won back pay plus compensation(without help from the CWU ,which I find very curious )

I think there was another one after whitemoor won his case, RM agreed to pay people there holiday pay but it was only those on 1 hour contracts.

Can't remember any others but I do recall W66"s case and he did post the official transcript of his tribunal, and for the life of me I cannot fathom why the CWU has not exploited this judgement nationally because it would protect far more FT jobs than any convoluted agreement to deliver D2D for free or 5 hour delivery spans
