The Dept of Work and Pensions have registered, recorded, documented my last injury for a dog attack, as "An Industrial Accident."
This was reported to me by telephone 2 weeks ago, and letter of confirmation is being forwarded to me asap.
GP also documented it as a Dog Attack injury too.
A meeting for a level 2 Stage decision, due to the above accident, is planned SOON.

RM are attempting, I feel, to claim that this was an "incident". ( Am I right in believing that an Acident on Duty, recorded on the ERICA system too, doesn't lead to a Stage?)
Are they able to disregard the DWP decision, so that they can push a Stage 2 through? They seem to be using Bully-Boy tactics, via a Regional Managers wishes...
Additionally, I was under the impression that any Accident causing 3 days or more sickness, had to be reported to the "Health and Safety Exectutive" by the Employers.
I don't think this was HAS been reported, so are RM remiss in this aspect too?

IF as, I suspect, they want their "Pound of Flesh", and do decide to issue a Stage 2, what Appeal Procedure can I follow up?
Basically, it is coming down to my being called a "LIAR" as they seem to be ignoring ALL Medical, Govt Dept and H+S evidence, just to prove a point...

As this meeting is very soon, I would welcome any definitive or general guidelines that I can use in my defence.

Several years ago, I had a Stage Warning, because of an AOD, which was reported on ERICA. It might have changed since, although I doubt it. :Sick

Anyone remember the days when morals were more important than punnishing someone for being the victim of an accident? :arrrghhh :Sick :arrrghhh

Ta, I think that I heard of them over riding the Ericas before, But...

Can they over ride a Govt Dept, who set the policy of Work Related Accidents GUIDELINES?
If so, what's the point of having Higher Authorities?

Surely, this is NOT the withing the Powers/Role of RM, as Govt Depts have the "Final Say"?

So, it would break-down into something like this:
A. Me, GP, ERICA Report, Dept Work and Pensions, ALL SAYING "AOD".
B. Two managers visting site a WEEK LATER, saying, "incident"...

SO, looking at the above, A. are all Liars, according to RM?

My head... IS spinnning. All of A. are dealing with "FACTS."
But, B. Are using their "value judgement/guesswork."

Makes you wonder, but "Alice In Wonderland" was allegedly based on a place locally, LOL !!!

Doesnt matter if classed as accident or incident, the related time of can be counted towards a stage warning, a decent manager would then at the time of interview say that in the circumstances the stage warning should not be issued.

What royal mail class the event as has no bearing on whether the time of is justified or not, an event happened and time off resulted, that time off is what triggers the stage, the interviewing manager then decides if the stage should go ahead

I had a AOD in March 2006..Slipped on black ice on my delivery.. Off for 2 months after my knee went. Had a stage 2 interview ( had the accident recorded with the DWP).
The stage was given after the line manager who in my opinion was one of the worst man managers I have ever seen . He informed me that after visiting the incident that it was clear in his mind that it was my fault.

During the next few weeks I had a meeting with Simpson Millar ..After a week they informed me that I had no chance of claiming after the local council (road wasnt gritted ) and the RM refused liability.. I received the paperwork off the RM lawyers plus the accident report from the said line manager...

The lies in the RM letter was stunning...They said the line manager was a 'leader in H and S, He offered snow chains that morning etc etc.. All lies (In fact there wasnt ONE snowchain in the office at that time ) ..

The moral of the story is that the management at RM (not all of them ) will do anything to pass the blame on any accident onto the poor worker doing their job rather than face the music themselves....They are all climbing the greasy pole...

Finally, what really made my blood boll was when he admitted that he visited the said 'incident' FOUR days after my accident was the last straw... As you cant appeal a stage 2 award even in the case of pure negilence, I submitted a grievance, even though I was successful , and at a stage 3 it would have all come out (it didnt get to that ) the manager wasnt even given a stern lecture...They all look after themselves... Line managers after a accident should NOT be interviewing staff following a return to work, because they are implicated in the events that lead up to an accident..

The line manager was eventually given promotion to a DOM and I was given IHR a few years later...At least I had the last laugh...

And the idiots don't seem to have realised just yet, that they can only climb that greasy pole so far, then they reach the point where further promotion is blocked. Blocked because they then reach the positions that have only been open for outsiders, the "jobs for the boys", the positions reserved for senior executives renowned not just for monumental failure wherever they've been, but also for handsomely rewarding themselves for monumental failure, and has remained their own private fiefdom for at least a decade or more.
Anyone joining RM at the bottom, and have ambitions to rise up the ladder, must become aware that the RM ladder, only has so many rungs on it. :Very Happy

accidents,which happen in the course of royal mail work, would normally be discounted

i had a AOD in 1997, i left royal mail in 2001 and re joined 9 months later, then i needed a operation on my knee as a result of the AOD . as i was at a new office the DOM wanted to see the documentation from DWP and no stage was issued.

i was on a stage 1 at the time and had 3 months off with my knee, DOM was very fair and no stage 2 issued
