Witnesses...who weren't there!!

Had a letter re, recent Dog Attack, most of which made sense from the manager.
I won't go into fine detail, but, one bit states, "...as well as witness statements supplied..."

HANG ON! There were NO witnesses - Just me and a dog only. ( Wasn't that a programme on the box a few years back? )

I do KNOW that two higher managers visited and photographed the location, Post Attack, about 1 week later, and questioned me fully, where I relayed a full/accurate account.

So if they've supplied "witness statements" surely, these are Value Judgements and NOT FACT?! They'll be based on My Account, so they are NOT Witnesses at all.
How can someone supply a witness statement for something THEY DIDN'T WITNESS?

The legal and grammatical definition of a witness are two entirely different things:

The legal definition is: Witness

A witness is a person used in a law proceeding to verify the correctness of the arguments or testify the correctness of the findings of the case, or provide evidences leading to make a conclusion after testifying himself by an oath. The testimony given by the witness is used to ascertain the facts considering its merit and relative weight

So in this Thunderthighs it depends entirely on the evidence they have provided whether they would be recognised as a witness later on. For instance if they say they witnessed the incident then they are obviously be telling porkies, but how would you prove that. If however, the evidence they give in their statement merely points out relevant facts (such as breed of dog, general description of area etc) and/or makes it clear that they did not witness the actual incident taking place, and the evidence gathered was "after the fact" then proper weight can be given in any future legal case.

YEAH, THANKS. I looked into this yesterday too.

So a "witness" such as a Professional Expert providing evidence in a legal case, may probably be a witness for the sake or arguement...

But it's still stretching the point, in my mind.

But this is the "Weird World of RM", so it probably counts!!!

Well, got meeting today re. the above but...

As an aside, there's "another" ongoing dog attack situation upcoming,
and dog owner denies all Liability ( Four months off INJURED, no joke.)

Apparently, she denies the dogs attack, and also claims I hit the dog, on the head! ( Had a letter in my hand at the time...)
Other postie now becoming a Witness, - lol!! - as he was chased/attacked twice by the same dog.

Gotta get my GP's notes to back everything up, plus other medical history etc.

So, the owner wants a day-in-court eh?

It has also been, recorded and documented as such by the DWP/DSS, confirmation letter on its way.
Verbal confirmation given over the phone over a week ago.

So, if they try to over-ride Govt Health and Safety Policy, Employment Rules, Dept of Work and Pensions Legislation, I assume I can appeal?
