unfair dismissal

Looking for a bit of help & info,I was suspended for 6 weeks then dismissed for loosing my bag which contained a set of keys for my walk,my bag was taken out of the boot of my car after I finished my walk & pouched off etc. ,I believe the boot was closed but can't be sure for certain,no mail was lost stolen or in-danger at any point....I was dismissed for endangering the mail & for not looking after royal mail property,surely keys have gone missing before & no dismissals have taken place,i feel as if i have been victimized because I'm a non-union member,I've been employed for approx 7 years with no warnings on my record.
Also I left a bag unattended for a very short period of time in a very quite area to run over to a customer to hand a pack over approx 10 mths ago,for which i was ticked off but nothing came off it,this was brought up in the interviews during the hearings approx 5 weeks ago,can they suddenly bring stuff out off the files & pin it on you like that to add to the allegations against you..i have lodged an appeal for unfair dismissal. do you think i have a case. :d'oh!

I reckon you are being treated unfairly BUT hold onto your hat cos the OH DEAR GOD YOU CANT USE YOUR CAR EVER EVER EVER brigade will be on soon telling you of your wrongs .

i don't use my car for delivery as such,just leave the office with 1st bag,i use my car cos i have to collect my kid right after i finish.

Technically yes I suppose you can be sacked fairly for loosing keys, especially as you mention you were not sure that you had locked the car. Ensuring the car either OMV or a PCOD it does not matter, is locked at all times if it includes Postal Packets, is in the security brief and I would think keys would come under it.

As to the previous history, yes, unfortunately they can use it to to show that there is a pattern although the link in this case is perhaps a little tenuous.

Thats the bad stuff out of the way. You still have a chance but you need to do some research at your DO. The dismissal has to be fair so what you need to do is find out from posties how many times people have lost Pouch Box keys, and what happened to them. If they were not dismissed you might have a case for the dismissal to be reversed of reduced. Hopefully if you do enough work then the Appeals Manager might reduce the punishment to a 2 year serious.

I would also try and check out legal advice some lawyers offer a free half hour, you may get a better idea of the strength of your case when you speak to an employment lawyer,

Yeah,but if he hadn't of used his car he wouldn't of been on the site tonight would he.

Have you signed the RM bond for using your car,does your office do this.
This may work for you if it is a no.

Have to say though your sacking seems a bit harsh.
There's people at my place who have lost loads of keys.

Also did you get any help from the union,even though you say you are not a member.

you need to apply pronto to the employment tribunal office. the time limit is 3 months (less a day) from the date of the act complained of (in your case - unfair dismissal), so of you leave it too late, the ET will not even consider your case, so get onto it ASAP.
