A/L whilst on sick
I have booked foreign A/L start of July,however i am currently on the sick,i'll probably not be back to work before the start of A/L but have heard i cannot go from sick leave straight onto A/L,is this right?the operation i needed was supposed to be in Jan,so A/l was booked 6 months after that,am now only 6 weeks post-op,unable to walk for long periods,still in pain etc.

That's right, you can't go straight from sick to A/L or vice versa. You'll either need to go back to work for at least 1 day before you go, or get a Fit Note to cover you whilst you're on your A/L too.
It's to stop the tiny minority of p**s takers, who abuse the system. So all the rest of us have to suffer because of them!

So you will still be on the sick when your annual leave comes up.
Just go on holiday as normal,report back to work after your holiday or whenever your fit to go back to work and then claim the holidays back as you was sick.simple.

I had a hernia op last year, was off for 9 weeks, had 3 weeks leave booked during that, which included a family holiday in Spain, went and when I returned to work I asked DOM how much leave I had left and he said 6 weeks, so I ended up with 9 weeks for the hernia, a further 6 weeks leave, 8 bank hols worked and another 2 weeks sick for hernia problem later in the year, in fact when I look back I was hardly in last year.....and it was bloody lovely!
Bit different this year, going to South Africa next month for 26 days, only leaves me 3 weeks leave afterwards, need another hernia!!!! lol

As long as you contact your employer BEFORE you go on A/L i can't see how they could stop you...or in fact force you back to work before your current "fit note" expires.

if you're off sick and been signed off for 2 months and you have a/l in that time you get your a/l back.
if your note expires on a sunday for instance and you are due on a/l on monday you let them know you will be taking your a/l and resuming work at the end of your a/l.
what you can't do is be on the sick and on a/l at the same time, its an either or situation. you are either on your hols or your on the sick.

again,thanks for the heads up,am gonna say & give them a rec. letter to state that i'm off on A/L,i'm not trying to get the leave back,i've been off 2 months & was off 6 months laat year when it first happened,just didn't want to give them a chance to have me by the knackers

A phone call to the office to say "im on holiday next week" and your covered!
No contact leaves it up to them to guess whether your sick or on holiday.
common sense has nothing to to do with it!
