STAGE 3 WARNING

hi all, im facing a stage 3 warning.
had atos doctor phone up 2day.

my stage 1 was due to being in hospital

stage 2: had an accident on duty and broke to teeth, which then had to be crowned. a year later had to have teeth removed because of absesses. Manager issued stage 2 as he couldnt find any conclusive evidence to link the absess to the accident at work, even though it was the 2 crowned teeth that had to be removed. did not have a return to work after this absence.

trigger of stage 3 - leg injury not on duty.

i have had time off work due to work related stress, although at time that manager changed it and put it down as family problems,

the office needs to lose staff as we are overstaffed.

does anyone know if they can sack me?

i have been back to work for months and now they are going on about this stage 3.

If you are having a stage 3, then the simple answer is yes, they can sack you.
Make sure you have someone with you with experience of this sort of thing. (Area rep)

I would hate to give you any advice without knowing all the details of your case. (Even then I wouldn't say I was competent to comment)
But assuming you have fallen foul of the attendance procedure, you need someone there to argue your case.
Are you a union member? If not, join. Your area rep will have experience of these procedures and will be able help you.
I know people who have gone in alone and defended themselves succesfully, but I always think it is better to have some experience on your side.

You could argue the stage 2 was unfair due to it being all related to the work related incident, which they should not have given you a warning at all. Could be worth speaking to your dentist to see if he will write you a letter saying it was all related in someway. Definitely get union representation, the higher the better (unless it Ward or Hayes they'll end up making you pay money to be sacked )

There's one guy in my office that's been sacked and reinstated 3 times now I think? He is completely usless, always late in, dissappears to the car park each day when sorting starts, off sick every month, etc. So even if they do manage to get you out the door, fight them to get back in they rely on people just walking away without a fight

thanks for you replys everyone, i have never been in trouble always in on time and one of the most efficient in my office, i have just been unlucky with the absences, but the stage 2 should never of been issued and area union rep even said they were bang out of order to issue the stage 2 but we couldnt do anything about it as it was a stage 2 and couldnt appeal, but the manager in the do at the time was a complete asshole and hated me, due to being a threat to him

I was the same and sacked under stage 3 nearly 3 months ago
i think arguing your case over the issuing of the stage 2 is your best bet

As Judgee mentions, definitely ask your dentist for a letter confirming that the two matters were related, the dentist may charge you a fee for this, possibly about £30 but it will be well worth it. If RM are foolish enough to ignore this evidence then I'd be pretty confident of you winning your case at an ET. If you get a good rep then it shouldn't get that far, good luck.

'conclusive proof. etc--and to repeat otheres, get your own dentist to confirm this. It may cost you a few quid, but well worth it. Good Luck.

You had an accident on duty which could have attributed to your problems causing stage 2,Get a note from your dentist to confirm your accident was the cause of the absesses,He had no evidence to prove the work accident wasn't related? Then go get it from the dentist,Just explain what its for and im sure he will sort u a note out.

2. He should never change the reasoning for your sick,If it was work related stress then that is what you should be off with,Not family problems,But if you have signed notes where he has changed your reasoning then i dont think you can do much about that one.

3. The most important,You never had a return to work?? How are you to know what is expected regarding attendance if they dont explain to you,They have a duty of care to ask about personal circumstances and offer any help they can,Maybe you needed some help but nothing was offered.

I have had 15 years in the hole and from what you have said i will be most surprised if they get rid of you,They have procedures to follow and basically have not done that.

i got stage 3'd for 2 absences in a 6 month period
1 a recorded accident on duty
i was dismissed for that
