Hello all. I was here before but forgot all my details, so I have rejoined under a different name. I had my appeal for dismissal heard at the start of the month and was 'stuck' in Tenerife (due to the volcano) when the envelope with all the paperwork arrived (well, a 739 did at least). I was supposed to return it the day before I arrived home but, seeing as all has since been explained, I have another week.
My eight week notice period ended yesterday (24/4/2010) so I am, for now, temporarily unemployed. OK, I may well win my appeal but I was wondering, should I lose it, if I would be able to sue my doctor? Despite me going to see him on numerous ocassions, complaining of knee pains, he continually told me it was 'my age'. He eventually sent me for an x-ray, which I always thought was pointless - as it proved to be - and it was only when I was lucky enough to be seen by a different doctor at the practise that I was sent for an MRI scan.
However, despite going to see Atos at Maidstone after the scan was suggested, I was, after working light duties in the Bexley office, given my notice before I even had a date for the scan! I didn't think I needed referal to Atos each time I returned after a period of sick leave (often disguised as something other than knee pain as I didn't want that to be used as a means to sack me - yes, RM would do it) because I believed my doctor. I now realize I should have TOLD them I had a problem - Christ knows it had cost me enough money over the last three years, paying others to deliver my sorted mail, rather than go sick.
Any thoughts?

Yep, that's me all right!
I should have added that the MRI scan revealed a medial meniscal tear and a cyst, and that the doctor who continually mis-diagnosed me charged me £30 for a letter saying so!

If I were you, I'd sue the Doctor anyway. That's terrible! Has the delay in diagnosis made your condition worse?

At least you had a notice period. My husband has been through all his fact finding interviews etc, and was waiting to hear a decision as to whether or not he was going to be dismissed for wilful and intentional delay. He sent the amended notes in on Monday 11th April and has just received a letter today (28th April) to say that he has been dismissed without notice as of 25th April. Why can Royal Mail take all the time in the world to reply to you, but you only have 3 days? Now the appeal process begins. He was originally suspended on 11th February.

He needs to get his ET1 form in, do not wait for RM's appeal.
