Does anybody know the timeframe for receiving the result of an appeal, its been 6 weeks and still no word. I understand the agreement says that you should get the answer after 5 days,then if there is a delay you should be told in writing why and when the decision is likly to be made. is this correct. Any info would be gratefully received.

hi
i had my appeal heard early november last year and i heard my appeal result early march of this year.They can delay it as long as possible providing there are circumstances such as it is complicated in detail.They should however inform you of any delay and that should be in writing but mine wasnt either.I am afraid its just a long wait!!!
IMPORTANT make sure you put in an employment tribunal claim if you feel that you have been penalised ,moved job,lost money unfairly.You have 3 months from the decision made by the rm manager against you and this time limit will run out before your appeal is heard.That is why there is a delay because the rm manager is probably consuslting with solictors

6 Weeks is a long time to wait, i was due to be dismissed on the 21/04/2010 due to a stage 3 attendance and my appeal hearing was supposed to be on the 25/03/2010 but cancelled as i had a job interview on the 22/03/2010 and got told i got the job that day, i started new job on the 29/03/2010.
I simply could not wait around for the last 3 weeks with royal mail and then have to wait another several months for the answer to the appeal.
So they way i see it, is that i resigned ato start a new job and never got sacked and never got a thank you from my lino for the last 7 1/2 years working for royal mail.
daft thing is i only had 1 days leave to use so got hardly any pay for the weeks notice i gave them either ( payroll said you work the week you are paid ).
But i am free at last.

The thing i dont understand is i put my I.T. IN at the start of the month (march) and R.M. have untill the 12th of this month (april) to respond, so whats the craic ? Do they have to give me the result of the appeal before they respond to the I.T. CONFUSED

On the appeal paperwork i got from the appeals office it stated 2 weeks for a answer to the appeal.
have you looked on the employment tribunals website at http://www.employmenttribunals.gov.uk/" onclick="window.open(this.href);return false;
I think that you have to lose the appeal before the tribunal but if royal mail know that you are going to employment tribunal they may suddenly give you the descion of your appael.

The IT reply will be separate, you have done the right thing by putting the IT in already well done. RM appear to drag appeals out

Then you find your out of time to go to an IT if dismissed .........3 months less a day.

ulster postie i had my appeal on the 11th dec at belfast an got the answer on the 12th feb still sacked i put my it form in i did it on line and ive had loads of correspondence from them s**t hole royal mail have yet again up till the 24th april as my case discussion is on the 24th may at belfast thats to see if i have a case for the tribunal so we shall see the out come the solicotor i have is crap an it will be the same one for you aswell as thats who the union use an they are crap i think you will know who i mean i still wont give up on them for what they did so i might get an independent solicoter if the union dont back me up i mean it takes months an its peples life styles that are involved im pleased im out now good luck

Well people things have moved on, got a phone call from the I.T. office today to advise me that R.M. have not responded to my I.T. they had untill Monday 12th april to do so, also i still havnt recieved the result of my appeal. Have been informed that the I.T. is now being passed to the chairman of the I.T. to make an default judgement. Anybody know what the next proceedure is, do i have to attend the judgement, or do i just wait and wait for the big cheque to arrive.

depends what reason you were taking the ET case out.
you probably won't get as much as you thought you would get.

if it sexual or racial discrimination - the awards tend to be higher, but if it's "unfair" dismissal (by default), they may find that you(the claimant) "contributed to your own dismissal" and reduce the award - as i say, depends on alot of things.
one thing for certain though. YOU WON'T GET YOUR JOB BACK!

Thats not true ... two posties at our place have got their jobs back since November.

im intrigued to read this ive been sacked for alleged non delivery of 200 d2d's and my appeal is tomorrow. ive got shed loads on the whole investigation and they haven't followed there own conduct code procedure ie' i haven't seen all the evidence against me which they are suppose to provide. im not expecting reinstatement cos royal mail and its managers are corrupt bastards! but im taking it to an et and im hoping to get them squirming under oath the bastards!
