Can royal mail sack sum one on the grounds of abandonment of duty cos they had to leave the floor to take an insulin injection for diabetes?? And is the union going to stand by and let this happen without a fight??... We need help in our office as the union reps r best friends with the Dom n go drinking with him, n don't want to upset him, so we the union members suffer

Wouldn't diabetes be covered by DDA?
If your Rep isn't doing anything, contact your Area Rep or CWU Branch Secretary asap.

RM claim the health, safety and welfare of their workers is paramount so a life threatening situation such as missing a jab would be an incredibly stupid thing to sack someone for.

Oh, and get yourself a new union rep.

Who said they were going to sack you for leaving to deal with a medical issue,the manager? if he/she did then i think who ever needs to take themselves of to the corner and get a life,if anything happens then whom ever should know that negligence is a very serious issue,if it was me in the same position then i would be having a chat with some one.

Yes they can sack you for anything, but then it's up to you to prove why they sacked you and show the employment tribunal. They would find in your favour no doubt about it as health and safety is paramount. Put in a grievance over harassment.

There's no way they could sack you without going through the disciplinary procedure first, and something like that would fall at the first hurdle if it even made it that far. The only person who will end up being disciplined or sacked would be the manager stupid enough to put his/her name to such a case!

Don't forget that section 7 of the Health and Safety & Work act 1974 requires you in law to take reasonable care of your own health and safety and that of others. And section 2 of the Health & Safety & Work act requires RM to take care of you as one of their employees. Yes we all know they are useless at it, but the point I am making is they can't touch you on this one.

What has actually been done or said to make you ask this question?

re;your shop steward have a meeting called and sign a petition and have him deselected,and no they cannot sack you and your union area rep and a tribunal would run amok with that nonsense

If you left your point of duty without permission the line manager is within their rights to challenge u and if they deem it necessary award a conduct penalty, your diabetes is a secondary factor, the point is u took it upon yourself just to leave your place of work. If i was your line manager I would succesfully argue that the fact that u have this condition and left the floor without informing someone put u at greater risk, what If u had collapsed? Managers have a duty of care and u would lose any appeal. And I'd stake my life u already have a penalty on your record!

An appeal could be won if you argue that you were discriminated against because other members of staff have left their point of duty on occasions without permission and have not been disciplined. Collect some written statements.

I suspect the reason you have been targeted is that even if they sack you and you win at tribunal, they will still be saving money.

Get someone in your constituency to write to your MP on your behalf.
