Help

Post by Lincox »

Can anyone please advise what the agreed procedures are for a part time duty day off cover, covering a full time duty. Can the part timer claim a full 8 hours duty cover, even if he doesnt actually complete a full 8 hour shift. ie part time hours 35 per week, covers a 40 hour duty but covers it in less than 40 hours.

No IPS involved as in small sub office. The full duties of the full time holder of the walk are completed by the part timer. so he does all of the work that the full timer is expected to do, but management are saying that if he does the duty in less than the full time duty hours, he can only claim the hours he works, whereas if you assume that both the full timer and the part timer worked at the same rate, the full timer would get 8 hours, whereas the part timer would only get the hours he worked. In the past the part timer has always been able to claim the full time duty hours, but now management are saying if he does this and hasnt completed 8 hours then he is defrauding the company.

Yes the full timer is paid 8 hours a day if he finishes early then he is not defrauding the company as he is not putting in for excess hours like the part timer. However if he was doing his day off on overtime then strictly as you are now finding out it would only be legal to claim for the hours worked. The only answer to this is to do it properly. Dont cut corners , take a meal relief etc and dont rush. It makes him look bad and puts you out of pocket
