Got a Stage meeting soon, and my CWU buddy will be there.
So, if the reason for the absence can be lnked to recent AOD's, is there "leave to appeal" if it goes against me?

Seems like there wasn't much they could do about the AOD's and possible Stages,( You could almost physically feel their frustration! ) so feel that this is their chance to
get their "Pound of Flesh." But, if AODs hadn't occcurred, then I wouldn't have had further problems, leading to this current situation etc.

Am I clutching at straws, or is there real chance for Justice/Appeal.

What stage is it, 1, 2 or 3? Don't think you can appeal 1 or 2. Stage 3(RTU) can be appealed.

Stage 1, but if you can appeal/stop it at the first stages then it won't lead to a 2 or 3 so quickly.

Why can't a Stage 1 be appealed against? Is this the "World of RM" talking?

Has anyone challenged this accepted but nonsensicle one-sided view if the Rules?

Thought the Right to Appeal was part of UK Employment law?

cant appeal a stage 1 or 2 but you can put in a grievance against it, they can issue it but if it added to a dismissal in the future then you would probably win an appeal or definately a tribunal as you cant be sacked for an accident at work

Ta Coxie. But, if AOD'S are having an adverse effect on your Life outside of RM, surely there's some comeback on the causation that led to this?

Put it this way, as an example, if you A, lost an eye during RM work, then had B, an accident crossing the road, by not seeing well,
Then...by association A has led to B directly? ( Not a great example I know, but hope you get my point...)

So an AOD doesn't go away when you leave the office, it's gonna be there 24-7-365 until it's better, of which mine isn't.

TT I had a S3 for an AOD and I have to be so careful now, scared of catching a cold as I was told if I trigger another one I'll be out the door as the DOM would'nt take in to consideration anything next time. If I do trigger another one and I get the gooner I'll be going to an ET thats for sure.

Have you got a copy of the "Royal Mails Rehabilitation Process" document?
Someone sent it to me before.

Scan reading it, it looks as though they'll bend over backwards to assist/help/rehab us.

Perhaps there's something in it to help out?

It it's in print, been accepted by the top RM knobs, CWU, Atos etc, then it's got to carry some weight.

Being computer thick, I can get it sent if you want...the wonders of having children!

Do they really bend over backwards to help us :shock: I've lost count of the amount of ATOS referals I've had, everytime a phone consultation and when I say I'm having physio etc all they say is ok and nothing changes. Its been 14 months now since my AOD, RM have'nt helped me once and I'm still having treatment and taking painkillers.
If you could send that document I'd appreciate it, would love to see if they are meant to help :wink:

if its an accident at work thats effecting your life then go to a claims company and claim compensation

Coxie, I have, and RM have admitted H and S "Liability", but looking into the Causation...long story!
Had appt with independant Dr look at it recently, CWU/Simp/Millar getting a copy each.
So, think I MAY have a good case, as if they have admitted liability, the injury goes wherever I go, not just to work!

Ok, Stormeister, I'll get a lighted stick with rusty nails in it, and beat my kids to send it to you.
Or maybe ask them nicely and buy em a Chomp and Refresher bar, the original lemon one always seems to work...

I'll see if they can send it to your PM. Probably be tomorrow.

what's AOD ? is that accident on delivery?


you cannot appeal stage 1 or 2 and you don't ever want to be going onto a stage 3 = dismissal !!

if RM are including time off for an accident on delivery - it may be possible to go down the Grievance procedure - am not 100% sure but if that was me...that's what i'd do...and if it was an accident at work and it was the employers "fault" - see your legal and medical rep and ask for an LS3 form too

Be careful about the Accident on Duty. RM have been "investigating" these and surprise,surprise are now saying if it was your fault then it is not an accident but an "incident". As we all know an incident is not discounted and a stage warning issued.

Nowhere in the attendance procedure does it say that an AOD has to be someone else's fault and it is another example of our caring employer perverting the agreement to its own ends. :evil/mad

The DWP have classed my AOD as an Industrial Injury, whats RM's stance on that?

Mine were AOD'S both recorded, officially too, with RM, ERICA, DSS, DWP
Can't be denied, overlooked etc. Have to take, in my opinion, this into account.
They've even admitted liability too, on one.
