Not Paid OT.

Post by dolphinsweremonkeys »

Off this week and just received my payslip. Thing is I had booked 3 hrs OT last Thurs and Fri, 1hr 30 each day but they have only paid me for 30mins! Need a bit of advice on what I should do. Back in on Monday and I know it is all going to kick off.

I know they will go off on one spouting on about flexibility. Is there a National Agreement on exactly how flexible you have to be?

I know there are alot of clued up blue shirts out there on this forum so any advice would be much appreciated.

Also I have read a bit on this site about people putting greivance's in. What exactly is a greivance and how do you go about putting one in and who do you give it to?

I do my job right. No car, steady pace on delivery. No problem with the job, actually enjoy it when left alone to get on with the job in hand.

In reference to the first paragraph mate you said they only paid you for 30 mins instead of the full 4 & a half.
It could simply have been an error on their part so to be safe I would clarify this first.

If they REFUSE to pay you the money for the hours you have worked, ask your manager for a grievance form. Tell him you are disappointed that he has failed to be reasonable and that with-holding wages is illegal.

Best of luck!

Signed out of office at around 10.15 so including 15mins conveyance did my first letter around 10.30, got my walk done by 2.10 then another 15mins conveyance back to office with a 30min break brings me up to 3.00. I am due to finish at 1.30, that gives me 1hr 30 OT. Dont see why they didnt pay me saying as DOM was there and seen me and what time it was when I left office.

most likely what's happened,is what's been enforced in our office, management insist you have to work 40 hours before they will pay you overtime, for example you could go over by 1 hour on monday, but you have to wait until the end of the week to see if you can claim,if you finish early on another day of the week, then they say it's balanced out,i argued this was unagreed and was effectively banking hours, but our area rep came down and backed the manager, saying he's only ensuring you work your paid hours, the problem being it doesn't apply to everyone,so some don't do 40 hours, yet others are doing work there not getting paid for.
good luck and let us know how you get on.

This is totally wrong and must be stopped!! Your hours are done on a daily basis! If you go over your working hours on any given day then you should be paid overtime!!

If they want you to go over your time or finish earlier one day they have to give you 24hrs notice. Also they can only change your finishing time upto half an hour and on only one day per week! So for example you finish 1 hr early one day then they can't make you work one hr over the next day!

If he refuses to pay you your overtime "Under your terms of contract" you seek legal advice through the union. You could also threaten your manager with a no confidence vote which is also a violation and ask him to leave the office. Maybe the manager has pockedted the money himself.

Thanks for all the posts. Just have to wait and see what happens on Monday. It's nonsecal that for such a large company like RM there seems to be so many different do's and dont's for each individual office. Reckon a national agreement on everything across the board would mean each individual knew exactly were he stood

Anyhow, still on me hols so I'l head on out for a few large ones.

if you are going to go over your time and want to book it then techincally you should phone 1 of your managers and agree with them that you can book overtime, overtime is at their discretion and if you dont ask then they dont have to give it to you, but on the other hand if they refuse to give it to you for trying to help them by going over your time then next time cut the fk off and tell them you would have gone over your time but your not in the habbit of working for free.

And robd yes your manager is wrong he is banking hours and he shouldnt be doing that. To all you guys whos managers come up with silly rules like this just cut off each time and watch how quickly they backtrack when they have to go out and deliver it themselves. They only take the piss if you let them

We argue this and get put on conduct code.No questions. We either have to complete or we get a meeting.Union agrees with manager over this.
