a question about absortion
We have been absorbing now for nearly 6 months and have been told that are absorbed bit is now part of our duty and manager admits that we are doing 4 hour delivery now which has been agreed by the union but the question i want to know is that if its a 4 hourwalk span and im on 30 hours how are we meant to get a break in all of this ? the union rep says its all been agreed and we dont get paid for breaks no more is this true ?

It may be under discussion as part of the Shorter Working Week but it most definitely and with absolute certainty is not correct.

so does that mean that we are entilted to a break whether or not its paid or unpaid?
And if we are entitled to a break where or when we supposed to take it ? as they give us 90 mins to throw off tie up and then collect are absorbed bit and then 30mins traveling time to walk and bag drops plus back to office and 4 hours to do the walk in so where would the 30 mins break time come from ?

Planned 4 hour delivers are not nationally agreed and break national guidelines.
The 1/2 hour break can be included at any part of the duty roughly in the middle of the working day. I would suggest that the break is taken before you go out on your duty this would be part of the 4 hours you mention.
If your rep has agreed and your manager has implemented a no break schedule (even if its not paid which it is) then they are breaking employment law. Go above the both of them to the area manager and or ADR (Area Delivery Rep).

The union rep says it has gone to disagreement but will make no diffence as were getting in park and look supposedly in the coming weeks and he is helping to plot the new 5 hour dutys .

i read these comments and have to just shake my head.
do not listen to your union rep if this is what he has said alson get in touch with someone from higher up in the union and get them down there asap.

your Rep/Dim Dom can plan all they like, the interim agreement prevents any unagreed implementation of changes to work practice .. the final decision remains with you, even if it goes to the IR framework. As TBT says, at present, there is no national agreement covering van and loop, nor is there any agreement on extending beyond 3.5 hours on delivery for town duties. Meal breaks are governed by European as well as UK Employment law, so there are safeguards built into your working day there too.
What any new agreement brings forth from the current talks is anybody's guess at this stage. Sit tight, use the IR Framework to its fullest and agree nothing at local level for the near future!
By the way when you look at the Pay & Mod Agreement you will see that 'lapsing' and 'absorbing' are two different beasts whilst achieving a common aim. Look carefully under Phase 3 and see whether what you are 'absorbing' is actually correct, or whether Dim Dom is using the practice of 'lapsing' under the guise of 'absorption' ...
