Guidance for reps and members regarding the Royal Mail questionnaires

Would there be any adverse effect legally as far as the union is concerned if we advised our members not to complete the questionnaires?

Non completion of the forms could not be deemed unofficial action but Royal Mail could argue that if staff wilfully refused a management instruction to complete the questionnaires this could open up potential disciplinary action.

The purpose of the questionnaires was in part to ensure Royal Mail don't fall foul of any discrimination legislation - by forcing people to alter start times when this may constitute a breach of race, sex, religion or disability discrimination. Royal Mail has to treat the situation seriously.

How staff complete the questionnaire is a different matter and while this tactic is unlikely to stall Royal Mail's plans we could ask members to respond that "they took the job because of the start and finish times and would only support changes based on agreement with their union (CWU)". Our members could also state “ I want you to reach an agreement with my Unionâ€

Surely the SDD agreement is a bound legal document signed between two parties. If this is the case, the CWU could and should take legal action against RM for breach of a legal agreement. I would love to see a dirty high court beating for RM
