WELL & TRULY SHAFTED! ADVICE ASAP PLEASE!

Post by rmapprentice »

As some of you maybe aware, I recently posted that hadn't been paid quite a bit of overtime. Simply because I didn't sign the '552' form, wasn't aware that this form had to be signed every time docket was done. I joined in November but was never told this after doing countless amounts of overtime.

Finally spoke got to sit down with my manager today, after days of them being busy or for some reason not being able to do it, they worked out the overtime due to me and we came to the figure which they would give to the DOM to authorise. A rather lot of docket (double figures). I was happy as larry as was told, I would have a nice juicy pay packet come next Friday!

Finished my duty and went to the manager to see if there (wait you guessed it!) docket going, there was but was told he was going to sit down with me and the union rep tomorrow about my O/T. I asked why, and was told in a nutshell, they can't pay it all as it's been too long and are willing to pay me just over half but over 2 weeks. Obviously, I was shocked and said no but he said we will discuss it tomorrow.

Where do I stand? What do I do? Can they do this? Advice please! Really annoyed! GRRRRRRRR :evil/mad

P.S. I have since been signing the 552 for all overtime!

If your union rep is worth his salt, you will get the lot, don't agree to anything less.

How long have you been in the job and what training did you get?

The union rep also works in the writing room. I started late November and there has not been a lot of training really to be quite honest.

What do I say tomorrow then? If they say won't pay me those hours....do I grin it and bear it or fight it all the way as I have worked these hours! I don't get up early in the morning and finish late at night for FREE!

Quote the Employment Rights Act (1996) Section 13 , Subsection 3

http://www.opsi.gov.uk/acts/acts1996/uk ... -pb1-l1g13" onclick="window.open(this.href);return false;

This basically says that If an employer pays less than the amount properly payable to an employee then this would be considered an illegal deduction of wages

Tell your DOM you may consult a solicitor or persue the matter in the small claims court.
And as DOM you will be naming him personally in the court doccument as he is responcable for autherising any due payments within the unit.

I think the matter will forthwith be concluded to your satisfaction.

What actually has your rep said about this, and wtf is a 'writing room'?

Also have you got a workplace coach there, and also,it's good that your training has been crap,if you know what i mean.

as others have said I would speak to your rep

as they have acknowledged that you have worked the hours in previously agreeing to you being paid them then I would inform them that unless you are paid the full hours you will take the rest back in hours owed ( ie time off)

I appreciate this can be hard when you are new but stand your ground

and in future any discussions about overtime owed that you have not received ask for an acknowledgment of the hours worked in writing

get everything in writing is the golden rule every time

hope it goes well for you

Why do people suggest a small claims court, it will cost the claimant to get money through a small claims court. The employment tribunal is the route to go. Been down the same road myself. :nana

Statutory retention period for wage/salary records (also overtime, bonuses, expenses) is 6 years - (Statutory Authority) Taxes Management Act 1970.
"Today’s workplace has become heartless and soulless. Employees are seen as units of labour, automatons, functionaries, objects for achieving designated tasks, and as costs to be minimised."
