urgent advice needed (now been sacked)
hi guys.
here's the story, was issued stage 1 in jan 2009, then had migraines with vertigo which led to a stage 2 on 26 nov 2008 and then had 2 days ill with vertigo caused by migraine in may then 3 days with the same in mid sept. i did have 2 days ill with norovirus on tues 29 jan 2010 and 30 jan 2010.
Heard nothing with regards to a stage 3 until i went to work on the 4 jan 2010???? then was asked by my manager ( loose term ) for a verbal agreement if ok that atos get in touch and now have a telephone consultation tommorow 19 jan 2010. I've had no letter to tell me that i am going on a stage 3.
Is there any agreement as to a time limit with regards the length between stages, usually it's within a few weeks after your'e last sick day.
any advice would be helpful as we have no rep at our office.

How can you have 2 days ill on the 29th/30th of this month??? Can you see into the future..?(If so... Are we going on strike again next month? will we get a long overdue payrise?? & will RM be a good company to work for again?? ) lol back to serious things - Stages last a year, can't remember off hand how long the 1st stager last for. Am sure if you explain things to ATOS things will be ok.. just make sure you make them believe that you are willing to work/fit for work & you love your job etc, etc.

I stand corrected then. I had an RTU god what must have been 14 years ago now, and the DOM said im going to give you another chance , and I went back to zero. Was also on stage 2, had been off once 3 months previous, and had to go off with cancer for 8 months - expected to come back to RTU but again went back to zero. That was 5 years ago this June, so maybe its changed since then.

Well had the consultation over the fone and the doc was surprised to hear that i had two days off work 29/30 dec 09 as royal mail had written to atos to say that i was still off work. what a joke!!!!!!
Still had no official confirmation about what exactly is happening, am i going to stage 3 or not!!!

just an update, just had the dreaded stage 3 interview appointment for tues 2 feb, and the letter was dated 20 jan 2010 and it states i have 3 days to write my defence or confirm the appointmen, How the bloody hell can if i only recieved the letter on the 22 jan 2010.
Also my stage 3 was triggered on the 8 sept 2009 and the stage 2 ended on the 26 nov 09 so how can the leave it for 4 months between stage triggered and stage interview.
and i only had 3 days while on the stage 2, looks like another right royal mail stitch up.
according to the atos report i have my migraines with vertigo under control and he believed my illness is genuine but may not be covered under the DDA act but the HSE think otherwise.
Also my stage 3 was triggered on the 8 sept 2009 and the stage 2 ended on the 26 nov 09 so how can the leave it for 4 months between stage triggered and stage interview.

what really annoys me is the fact that they have waited 4 months between my last days sick when the stage 3 was triggered till now to inform me and give me 12 days notice for interview, the dim never even gave me the form himself as he left it with the keylocker to pass it on, what a chicken!!!!. he kept hiding when i got back to the office between collections.

Well had stage 3 interview yesterday and i'm unsure wether it went well or not!.
we challenged the DDA act as its the effects of my condition rather than the condition itself and the manager who interviewed me is looking into it further, then another meeting when he's made his descision?, so i'm thinking if he decides i'm not DDA i'm out, but stay if i am?. ATOS letter states i may not come under the DDA act?.

After 4 weeks of waiting, today had another interview with regards to my stage 3 with an answer.
I have been given SEVEN weeks notice!!!
so i guess i will appeal against their totally insane descion as atos seemed to think i wont be covered by the DDA but my doc seemed to think i am, their descion was that i have no underlying medical problem but atos said my condition would be clear within 2 years
HOW stupid are these people.
Any know how long the appeal should take. thanks in advance.
