I am writing this story because I and a few of my colleagues at work feel very strongly about the treatment of a fellow postman.

This post may well be identified by management, if there is a risk then let the risk be mine. This is a genuine story and I most certainly do not want anyone to put themselves in jeapardy

We are simply trying to get any information to help the reps case. We have only just got the full story.
Maybe someone can point me to a certain page in the conduct code or something legal, a link would do.
Management have said the case should not be discussed as it is confidential, a fact that hinders the reps defence if you ask me.

TBH there is not much he can do except take the appeal through all the internal RM stages and then go for an ET. I have no reason to doubt the veracity of the post you have made but if true there does appear to be many weak-points and hopefully he would win an ET with ease.

As a unit there is not much you can do at work but they certainly can't stop you expressing your opinions outside of work and they certainly cant stop you starting a campaign for his reinstatement.

Is the sandwich machine a good one that stops you from making your own and bringing them in.

I don't believe calling someone a w****r constitutes gross misconduct.

From what you say, it does not look like management have made any attempt to resolve this issue informally.

People should not be afraid to express their opinions. Let's not censor ourselves through fear.

In my opinion, management use the hitlerian tactic of threat.

If the management's lawyers don't like it, they can make a move.

Sounds dodgy to me.
Apparently Royal Mail have a very clear conduct code proceedure, I wonder how much they actually stick to it themselves.
No I'm not being paranoid, they really are out to get me.

Also, if you think your area rep is stitching you up, raise a petition and send it to someone you trust in HQ.

Management stopped the area rep coming in on the local reps interviews, they said there was a conflict of interest.

I have looked into this and there is only ever a conflict of interest if the area rep had been advising the accuser namely the quadrant guy and also advising the accused namely the rep.
I fail to see how sitting in on witness interviews can be viewed as a conflict, sitting in on witness interviews is all part of defending the rep.
He did not sit in on the accusers (the quadrant guy) interview.
The area rep seemed to accept this decision from management and didn't really fight it although he helped the rep get someone else to defend him, this someone else (CWU divisional rep) came from another geographical area and by all accounts wasn't very good, it was at the time of the strikes and he seemed to be far too busy with other things to give the case the attention it deserved.
very disingenuous & duplicitous the bit about the " conflict of interest " - a case built on sand . Who is trying to impress who and whom ? . The Union want to get their act together or it'll be a who will be next ? scenario - exactly what the Union Busting RM want ?

We do get the impression at work sometimes that the area rep is more interested in placating management than actually fighting for postmen.

Tampering with evidence that could help your case, I don't know how that would look at an employment tribunal.
Stopping your rep from coming in and only seeing the evidence they want to see as in disregarding the witness statements.
I don't know what sort of justice a person will receive at an employment tribunal but if the judge is fair these points should help you.
I mean if someone takes a dislike to you in a job and makes a complaint, is that all the evidence they need to sack you with these days?
I'm surprised not many people have commented on this thread, I guess people are paranoid about RM reading their responses.
