HOW TO BEAT ATOS

I was reading an amusing story about two doctors who lost an employment tribunal against ATOS. Essentially, they believed they were not being allowed to weed out "malingerers."

There was more to this story than meets the eye and I was interested in the complaints process that the "malingerers" had apparently been allowed to use to their advantage. Dr. Branton wrote:

"if a doctor at Atos racks up more than three complaints in three months, he is disciplined. First, he is warned by his supervisor. If the problems persist he is given, in effect, a final warning that his work will be cut or that his registration to work will be revoked."

This prompted me to look at RM advise for handling complaints against ATOS. It seems there are two routes:

Management are told that if a member of makes a complaint against ATOS then the complaint should be forwarded to RM manager in the CSA health team, HR Services.

However, if a manager wants to complain about an ATOS decision etc. then they should contact the ATOS contact centre on 0845 612 4123.

I suggest that anyone unhappy with their ATOS decision should complain via the contact centre and request all communication by email. All complaints are forwarded by ATOS to RM anyway.

We have a guy in our office,who has been seen by the Companies medical People and he has a serious amazing condition.
In working hours normaly in the office his condition is very bad,very serious,medical people say he needs to be on a part time round without making his hours up ,he is allowed to do IPS as and when and if he feels like it .Everybody in the office knows how bad his condition is.This GUY IS VERGING ON DISABLEMENT HIS CONDITION IS SO BAD.

Yet frequently out the office away from Managers,and always out of working hours his condition totally disapears,not only that but his hobby wich every one knows about and even featured in the local paper requires a high level of personal fitness and upper body strength,just something this guy does not possess in working hours.

Yet he is paid same as every one else and no Manager dare say boo to him but if we cut off on full time rounds we get 20 questions!

Puppetmaster:The guy with an "amazing" injury, I can sympathise with. I do training at a high level, but for example with todays snow/ice, I struggled with a leg injury.
Slipping 6 times or more, and correcting my balance, gave me electric-shock type pains.
If it's under my control, I'm fairly ok. If it's a sudden, unplanned and instant movement then I'm in agony for a few seconds or more.
Regular physio and home re-hab exercises help, but after 2 yrs, it's a bloody pain - literally!
So, I'm not supporting lead-swingers, but some injuries only manifest themselves at certain times, maybe this is similar?

And indeed some illness you wouldn`t even know the person was suffering with it.
I myself have a serious illness, to look at me I look fine,most of the time I manage to do a full rural delivery that no bugger wanted in the last two resigns as it`s so long,but I do on occasions have the option to drop some hours(not that I use it) as I have regular lumbur punctures to relieve the pressure in my head, and my back can be sore for a few days or I might even god forbid get a low pressure headache that can knock you off your feet for a week.

I also play the drums in a band and have done since I was at school over 26 years ago,you see us DDA are allowed to have a hobby,we all arn`t fucktards who must sit dribbling into our tea or sat in a wheelchair as all DDA must be cripples or a bit simples?
Yes there are people who can take the piss(especially if your a Daily Mail reader ) but unless your with them on a 24 hour basis how the heck do you know he does his hobby only through taking large amounts of painkillers or that he might even be able to do this amazing healthy hobby and then might suffer for the next few days?
Come to think of it ...f**k it.....tomorrow I`m going to tell them to put me back on the kill offs as thats about all us cripples are capable of my regular customers can feck off.

I've heard of RM staff reporting ATOS staff to the General Medical Council or their nurses to the Nursing & Midwifery Board or Council ?

"why wait forever" is a great link brothermagrew.

It would be interesting to see whether staff complaints against ATOS are dealt with as quickly and efficiently as management complaints. Hopefully, if staff use the management complaint route, ATOS will have to treat us the same.

What I thought was funny about the Daily Mail story was the way in which the "malingerers" were benefitting from the complaints system. Maybe the Dole Office staff were supposed to re-route "malingerers" complaints but couldn't be arsed so they just gave out the phone number instead.

The two doctors lost their tribunal case big time and ATOS want them to pay costs. How naive were they? Couldn't they see that no court would find against ATOS for giving claimants the benefit of the doubt and all they would achieve would be to make ATOS look like the upholders of fair play. Indignant Daily Mail readers have been given more reasons to claim that people have "too many human rights," and if the Daily Mail egged on these doctors, then the Daily Mail should help them out of the brown stuff.
