Bit of Advice for a friend

So a close friend of mine has being suspended on full pay since the middle of last week, basically 'the person' was on holiday for a few weeks round about the 20th Nov, one of the bag drop boxes had around maybe 30/40 D2D leaflets left unknown to 'the person' upon returning back to work 'the person' got called into the office and has being accused of fraud and deception and willful delay. Photos have being taken and on clearing the box out as it was just full of rubbish there was the tinyest postcard hence the willful delay. Now 'the person' is the only one who uses that box obviously the cover person does on the days off etc.

Do you think the above is grounds to dismissal? I find it laughable that 'the person' said another member of staff left a bag in a box because they was new and didn't know the round the driver found the bag next morning and they got let off not even a smack on the wrist.


Hope the above makes sense just trying to gain some thought from fellow posites etc,


MODS please remove if you feel it can be found by RM management of the like, I don't want to make it worse :crazy:

on the d2d side of things he can just say they were the ones left over. With regards to the postcard there is no proof it was him who left it in. Like you said his day off man also uses that box. Just tell him to deny all knowledge of the postcard. They can not prove it was him!

That's the advice I have given, I can't see how they can prove anything at all? I belive 'the person' has denied all knowledge of the D2Ds and Postcard they belive the box was empty with noting in it apart from rubbish when 'the person' went on holiday, someting smells very funny.

what weeks the d/d's should have been delivered, narrowing down the field.but, it does sound very dodgy,,usually the doms only behave like this when they want somebody out---usually because that person has stood up to their bullying tactics.

Well I belive it's the weeks D2Ds leading up to just before the holiday, the D2D sheet was handed in all filled out and signed. I feel my friend is being stitched up here and the management want the said person out, my friend has filled a grievance out towards the manager. The said person is already on a Stage 2 for absences from an Abcess tooth with all letters and doctors notes etc.

just because they were by his frame doesnt mean they were his, tell him to say his door to doors were clear and somebody else must have dumped their door to doors under his fram cos many people get the same ones, unless they have marked them all up to prove they are his then they cant prove it.

the manager is a cock,we have had that sort in our office ,we had one move due to him being sued and a load of grievences put in against him,we have another who is the same and is on borrowed time,we have had the worst have your say in the area for years ,they send some bod down who says leave it with me we will sort this out,then you never see them again,we had one swear blind the manager would be moved and was disgusted and swore she would be back the following week.we all said of course you will.you know what happened.

hi,good advice but you need to release under employment law they only have to have a resonable belief you did it to find you guilty ,,its a joke,

The above scares the absolute s**t out of me! Yes I'm sure we've all the bent the rules and we've all make mistakes. Is this really a reason to dismiss someone? I'm looking for another job. I really am. If your manager wants you, he'll have you. Young, old, fast, slow, male, female they could have you. Simples. No one is safe in the general workforce. No matter how perfect or how well you think you do your job, they could have you. The majority of them really are a pack of spinless, heartless, vindictive, twisted bastards.

What happens when managers make mistakes? What happens when managers bend the rules? The management in Royal Mail is a joke. I've said it before and I'll say it again, right from Mr Adam Crozier himself to the lowest management grade their is, the most of them are incapable, incompetent, lying, deceitful cheats. How on this earth and in such a big company can they get away with it!? Managers are nothing short of Hitler or Saddam Hussein. And look what happened them..........eventually. I long for the day the mighty fall. I really do!

There is one very small glimmer of hope though - that ruling was under the jurisdiction of Northern Ireland so the applicable laws may not apply to cases in the rest of the UK.

However, it does highlight the need to only claim what you actually do, that way you will be safe from such harsh and unfair discipline.

My manager always chases for the D2Ds sheets on Fridays and I have normally finished by then so I put it in. However, if I haven't and even if I am going to complete on Friday - I don't sign them off, something may happen on delivery that will stop me delivery them.

It also shows that if you have any evidence you have to use it within RM's conduct proceedures IE before dismissal as a tribunal will not allow the use of new evidence. Not sure if this applies to UK law though.
No I'm not being paranoid, they really are out to get me.

It does. An Employment tribunal can only judge whether dismissal was fair given the evidence available at the time of dismissal.
