Hi as ALWAYS NEVER go in on your own take your rep or area rep but watch out for the old trick he may call it a fact finding interview, loads in my office get caught out this was, and NEVER NEVER trust a MANAGER.

Re: Conduct Code appendix 4
If your an asst-rep he has to get in touch with your area rep or divisonal rep before any interview can take place.
Either of these two has to be present and until one of them is available to attend dont go in post pone it.

So what does this mean to me? does my area or divisional rep have to be either informed or present?brothermagrew wrote:Just happened to have finished reading this Employment Appeal Tribunal and it may open your eyes a little:

Re: Conduct Code appendix 4
Sadlersbitch, I am in the middle of a dissaplinary, and was informed that RM do not regard dep reps as fully fledged reps, so appendix 4 would not apply.sadlersbitch wrote:So what does this mean to me? does my area or divisional rep have to be either informed or present?brothermagrew wrote:Just happened to have finished reading this Employment Appeal Tribunal and it may open your eyes a little:

When our divisional rep challenge this, the dissaplinary manager capitulated, and accepted me as a fully recognised rep.
So it would be a good idea to get your divisional rep on the case as soon as. FOREWARNED IS FOREARMED.

Re: Conduct Code appendix 4
Deputy reps are entitled to classification under appendix 4. I have experience of this when I was deputising for the full-time rep. If the DOM has an issue with rep/dep rep he/she is meant to contact the area rep before ANY SORT of interview takes place.A while back I got suspended on some fabricated charge for 7 weeks and the DOM never let me know the reason why and he also never contacted the area rep, both of his failings helped my case in the end, I have to say, in our delivery office false faces have more brains than managers.

Re: Conduct Code appendix 4
just tell the manager that your area/divisional rep cannot make the appointment so he will have to reschedule it.
tell him that you will let him know later in the day when he can make it and reschedule it for when he can make it
dont let him talk you into going in without your devisional rep explain to him that you have been advised to wait for the divisional rep.
dont be bullied by him

Re: Conduct Code appendix 4
Listen mate your DIM knows the procedure for taking a rep or asst rep down the conduct code.
Unfortunately your DIM is trying to overide that procedure may be for his own gains.
You have to be strong enough to lay down the law him regardless of how daunting that may be to yourself.
He cant refuse you as he knows this is the rite way to go about it.
On getting suspended for 7 weeks ( not you BelfastPosty) a DIM if knowing they are going to suspend a rep or asst rep HAVE to inform the divisonal rep 24 hours before this is to happen , so im a bit puzzeled to whats gone on there.
Stay strong and good luck let us know how you got on.

Re: Conduct Code appendix 4
Were next whats there next turn going to be.
Could this be a case of your DIM showing to the staff that if they step out of line this is what will happen to them and im not implying there that you have done anythink wrong.
Just make sure you keep in contact with your DIV rep and keep your DIM imformed of the advice you have been given by your DIV rep on when the interview will take place.
Once again good luck and stay strong and keep us posted.

Re: Conduct Code appendix 4
well had my meeting div rep by my side
lots of loaded questions as expected
Manager doing interview said at end he believes the evidence i produced (Royal Mails own evidence) but he will let me know in due course!
got the notes of interview suprise suprise all out of context and nothing about him believing me!
A few days before meeting my DIM asked me about case i told him i was saying nothing to him and that i was suprised at the lack of evidence next day he goes to the complainant and gets another statement! it appears he is trying to predujice the "case " against me
i feel a grievance procedure coming on!
