If the employee wishes to appeal, he/she should tell the manager who imposed the penalty within 3 working days of the written notification of the decision to dismiss. A hearing will normally be arranged within 4 weeks and the employee will be notified in writing of the time, place and manager dealing with the appeal 5 working days or earlier by mutual agreement.
An employee who appeals can be accompanied by their relevant union representative or a colleague from the same work location. The appeal is a re-hearing of the case. If new medical evidence comes to light at the appeal the Appeal Manager may adjourn the hearing to seek the advice of Employee Health Service.
The employee will normally be told of the outcome of the appeal within 5 working days. If there is significant delay the individual will be informed of the reason and likely new date. In all cases the employee will receive a written notification of the decision with reasons.
Dismissals will take effect from the date specified in the dismissal letter. If management is unable to arrange an appeal in a reasonable time, an offer extending the notice period may be made, at management's discretion.
In the event of a successful appeal and consequential reinstatement, continuity of employment will be preserved.

ive got my appeal date through its next friday so hopefully i can now move on an get it over before xmas but ive not really talked to anyone thats had to go through one before so im a bit nervous does anyone know when you find out if you hav won or lost an if won do you get reinstated straight away an get all your entitlements back an the worse case if you loose will the union rep decided if its worth going to a et as ive been victimised without a dout

the union decide wether to support you sharon,however if they dont its not all lost i know of a guy in my office who took the tribunal himself and won,however you can win and get rewarded your job back and r/mail still dont have to remploy you(i still cant work that out,mind boggling)if uyou do win and r/mail re-instate you ,you will get all lost wages back,you have to fill in a form in the office on your return,hope this helps sharon,ps i know how you feel as iv now been suspended 6 months for nowt.ps i think its about 2 weeks to get the good or bad news,keep your head up girl i know its hard but r/mails game is too break you down...focus and hope r/mail do their usual and foook it up

I have heard you can win your job back and RM can be difficult and give you a job elsewhere in the business saying your old job is no longer available I have also heard of people winning compo and the company never paying it although this was not RM it was a judgement on a small business.
I would like to know how RM can not give you your job back when a tribunal says they must.

what i heard was they r/mail have a loop hole and they exercise it in most cases,imo this must be challenged by the union either in brittish courts or indeed in the euro court,alas i dont think they will re costs that would be incurred

Order for Reinstatement or Re-engagement

Even if Royal Mail are told/ordered by an ET or an IT they do not have to comply with it, although compensation can or is normally is increased in your favour! i just hope i can win my appeal as i have only claimed 1 hour ot but i did work it an there is alot more bad cases than mine its just a very dificult time for me its so unfair

Ref the bold sharonbar thats bloody quick from what I have seen, normally they take at least 5 weeks plus!

I really hope you win Sharon, While you have found it difficult to express yourself on here you have also come accross as a nice person, a fellow postie being mistreated and sacked on trumped up charges, it's a joke of a company we work for now, such a shame as it was a good job a few years ago.

Somebody else from there took RM to tribunal & won having been fit up - he came back to a charge of " Failing to show Dignity & Respect to cage cards " as he threw some up in the air
A RMC member was threatened with B&H for mentioning the sorry saga on here - Orders from very on high ?
