interveiw this morning

i have my interveiw today for gross misconduct an false claim of 1 an a half hours overtime they know what time i finished but they dont know what time i started an some days when id finished i just came home early what am i suposse to do can i say to them i can take them to a tribunal for harrasment an also mention the convention act article 8 for invading my private life am suspended but thre is another lad up with the same charges an hes still at work his interveiw is before mine so could i also mention justified discrimanation to them i know its my own fault i never took my meal breaks as im only there 4 hrs an help please my union man is going to be there

Good Luck Sharon, I hope all goes well for you. Make sure the DOM has got a note taker, as everything that is said should be recorded, just incase you need evidence at a later date. Maybe switch your mobile phone on record then you can compare the interview against the notes.

well had the interview an i dont think it looks good there was my manager an a note taker he kept trying to trick me out an was horrible but he said he will go an do some more investigations an said i will get the decition in 10 days time where i will have to look at his mug again but union rep said its not looking good he said that i could be prosecuted for falsely claiming 1 an half hours overtime union man said to me he was expecting me to resign then but i havent i aslso got accused of claiming ot an not deluvering all the sky mags he said he had photo evidence for sky mags left but didnt see photos he asked me if i wanted him to take any thing into consideration i said ive a clean record an not been off an i told him an showed him that i had thought about them as i was due into hospital today for hernia op but i cancelled it an he said he would consider but i know im a gonna the other lad had a good interview the rep thinks he will get a serious for 1 year an hes still working where as im not im still on suspention but he said there will be changes made to my duty as proven it doesnt take 4 hrs so why did he tell me that if hes gonna get rid off me

reading between the lines - which has been difficult as there's no sentences or punctuation ! - if it was more coherent , people might be able to help you better

Forgive me if I'm wrong but the Union man doesn't sound very good from my experience , he sounds like a buffoon ; not necessarily a bad person but somebody harking back to long gone days when managers were relatively benign and more interested in playing " games " and his release time or at best hoping he won't get the " Royal Mail treatment " himself ? .

Too cosy ? - there seems to be the usual prejudice against AG's - well I never ! , the manager knows he'll get slated for sacking a old timer and unfortunately you're disposable . The place sounds if it's a bit lax and it's been leant on from above ?

That bit about resigning sounds like they want to sweep things under the carpet - why ?

You and somebody else will have to be a lot tougher and start calling that manager's bluff and contradicting and challenging everything he says and does - Use the magic words Industrial Tribunal & Equal Opportunities , sometimes ! they work ? .

The bit about the other guy stinks ? - the bit about prosecution is cr** , it would cost RM £500 + to bring about a private prosecution & out of whose budget ? , if the round doesn't take 4 hrs why did they " test " it on a Sunday morning ? ? - that'd probably frighten the wits out of a cassie who dumped mail because he'd been in a night club before he came to work but not a regular postman ? - it's laughable are they going to throw you into a paddy wagon or frogmarch you to the Police Station - I think the Police would have more pressing concerns ?

I'd see a Employment Solicitor - you are entitled to 1/2 hour free , I wonder what they'd think of that manager and the funny goings on ? but you'll have to explain things step by step and coherently better than you've done on here or he / she won't be able to help you and it'll be wasting time ?

norbet hi well all i can do is wait for his decision not the best at spelling so if im dismissed do i ask for an appeal as its unfair if i am an my fellow colleague is ok to me its discrimination between us both he was horrible my boss yesterday so you think he wanted me to resign when he mentioned there could be a chance i might get prosecuted the union man said to the other lad your ok you will get a 2 year serious but he said to me time to look for another job i got accused of claiming ot on the sky mags but the other lad didn't where is the justice in that accusing one but letting the other off i know i will hear before 10 days as hes a little s**t ive tried to talk to another rep but they have been to London today so i will try again on Monday
