If the CWU dropping the proposed court action is not part of the deal, I'll be amazed.

It might be better if we don't go to court. Have the CWU thought seriously about the consequences if the court sides with Royal Mail and says bringing people in to clear a backlog is NOT illegal ??

It would give them the green light to use that tactic in any future dispute, severely negating the power of striking for generations to come

I will now be pushing my Branch Chairman to request answers from the CWU hierarchy to justify why they are not bothering to challenge fundamentally wrong practices. To me, this is a slap in the face to all postal workers from the CWU.

Mercian, I'll say it again - that court case was a huge risk. To lose it would blunt the only tool the working masses have - withdrawal of labour. If the employer was found to have a legal right to just flood the offices with temps the day after a strike, we truly would be f**ked forevermore

Barry, it has not been judged to be legal or illegal, The court case would have determined that. Great if the law came down on our side. But look at the consequences if they ruled in favour of Royal Mail !!!!

So as it is -without the legal challenge, the CWU have now given Royal Mail carte blanche to keep employing agency staff to do the work of posties - not just at the mail centers but also all these "hybrid" drivers we have sitting round for 10 hours a day !

Risky or not, advice has been sought from council and council would not be putting a case forward if there was no justification. Or is that what the CWU are now saying - employing agency staff to cover strikes is acceptable and legal ?

The TUC possibly had a word with the CWU about the wisdom or not of mounting a legal challenge. Losing the case would affect other unions across the land - it could potentially enshrine in law an employer's right to use agency staff to undermine the effects of a strike.

RM weren't proposing to bring these people on the day of the strike(s), they were planning to bring them in after, which is a bit of a grey area. Do we really want their right to do this confirmed in law ???
