Hello all,

hope you are well.

I am currently off work with 100% work related stress. Before I went off my (lying, cheating, deceitful) Assistant DOM was in the process of preparing a very petty conduct case against me. To be honest I am expecting the worse outcome on it. It's a very complicated situation. I can't file a victimisation case or do anything until this conduct case has a closure one way or another. My Rep has been an absolute rock and has been with me all the way. This is kinda new territory for him and most definitely me.

My questions are-

(1) Currently my case is with a sector manager who has to choose whether he will deal with it or it should be dealt with locally. If the sector manager calls me for interview whilst I'm still off sick can he dismiss me there and then? Also if I were to return to work and be called for interview with the sector manager, could I be dismissed there and then in that situation?

(2) If I am dismissed and I appeal it straight away (which I definitely would be), is my dismissal then 'suspeneded' for 'x' amount of time until a decision has been made on the outcome of the appeal?

Any detailed help as usual is very much appreciated.

maybe you missed it, have a look anyway. basically have you had a letter setting out the "charges" re the conduct thing (can you say what it is, by private message if you like) and also have you had a fact finding interview with your line manager ( ie the lowest ranking) with the union rep present ?? nothing should be passed higher up until these have taken place.

Hello Mailman,

thanks for all your info. Very helpful. The current conduct case is my second one in a matter of months. The first case presented charges of wilful delay of mail, putting the universal service at risk and causing the business unnecessary costs. This case has now been closed to a certain degree. However the second case is far from closed. The only thing that has happened so far is that I have had my formal fact finding interview with my Assistant DOM which my Rep was present.

The only thing I am aware of is that the case has been passed up to a senior manager. Apart from that, I have no idea of what is happening. I have absolutely nothing on paper stating any charges against me so far.

ATOS have now told me that to get my stress and anxiety levels addressed this conduct case has to have some sort of closure on it as a matter of urgency. The outcome of this conduct case is quite vital as the result of it soley depends on whether I will ever be back at work. If the conduct case is not a dismissal then ATOS and my Rep will be helping to get the problems sorted with the lying, cheating, deceitful and incapable managers, before I can ever return to work. However I can only file a victimisation case AFTER the conduct case has been closed. My Rep has informed me they will not run a victimisation case along side a conduct case as this could effect the outcome of the victimisation case.

If I am dismissed then it's a totally different approach. I'm guessing I would have to appeal the decision then file the victimisation case?
