hi can someone pm me with advice regarding this.
i was a postman for 6 yrs , during that time i injured my back and got ill health retired. i fought with the union and i won my job back but after being back it wasnt the same, i lost my duty and so made me a float man and then i was just being given the bad rounds . the final nail in the coffin was a round i was given which was about a 3 mile bike from office. i told lino that is was effecting my back , he said your backs fine thats why you got your job back . i did it for 3 days and kept on complaining , it got to a point where i just drafted up a letter of resignation and handed in my notice. also sent one to union stating the reasons were blaming manegment and mostly dom for making my life back since injury hell.
have i got grounds for constructive dismissal or is it just bad timing for me and whats done is done?

It sounds to me like you've got grounds for an ET, but don't expect the CWU to back you, they will only take on a case if it's got more than a 50% chance of winning.

I hope you've got all the documentation regarding your case, then talk to the CWU & try the Citizen's Advice centre or a private solicitor.

It sounds like you have a case but I hope you finished recently as you have to get the ET1 form in within 3 months of the incident,i.e your last day of employment.
Also you will have to show that RM have been bullying you or making it impossible to work for them and so had to resign.
Give Acas helpline a ring on:08457 47 47 47 they will be able to give you some good advice.
Oh and if you do decide to take them on hope your in it for the long haul as RM will drag it out for as long as possible. :roll:

I thought if you won ur job back they gave you ur old duty, so just wondering why didn't you get ur old duty back???

my duty was took off me while i was on rehab beforegetting my ihr then when i lost my job and and won appeal i found out my duty which i had picked had been turned into a bag carriers duty
