I am currently on a Rehab plan following an AOD where i was struck by a forklift severely damaging my foot, now i am being blamed for the accident and the manager is saying that he told me not to go out there? he did not say this but soon after i came back from A&E in a cast he was coming in to van bay with safety signs etc. I think he is trying to cover up big time any advice greatly received please. Accident Investigation done Forklift has had modifications to it like new reverse beeper and speed slowed down, fact finding done and in the FF the manager asks for any other things on record to be discussed all of which were dropped due to saftey procedures being adhered too by myself and still he tries to bring them into FF meeting?
I smell intimidatation and Bullying! Anyone have any advice please?

A TNT driver offered me his letter today to post so i told him to put it in the postbox as i cannot accept mail off the public he called me a F***ing prick i told him to use DSA Down stream arseholes he soon disappeared.

Bullshit all i see is Leighton and Crozier Bullshit

Might be a good idea to have a discreet word with the Health & Safety Executive and / or Council Environmental Health :hmmmm - just a thought ! . They take quite a interest as RM are being monitored by them , on paper RM's policy is good but compliance is poor hence accidents becoming " incidents " and employees " suddenly " becoming blameworthy to massage the figures .

I can see why people on here bang on about reporting accidents to the Social and getting them classed as Industrial Accidents - it CAN make it harder for RM to close ranks and play politics

A Industrial Tribunal would take a very dim view of detriment applied to people over valid H&S concerns .

My understanding is that your manager should have reported this accident as a RIDDOR http://www.hse.gov.uk/riddor/riddor.htm#who so all details "should" have been included on that report. This is assuming you have had 3 or more days off due to the accident and if you haven't already then get it logged on an ERICA accident report.

If any modifications have been made to the area or equipment that was involved in the accident after the event then these modifications should also have been recorded. If you have any evidence or proof of such, keep it or report it on the phone line on the link above.

In any case report it to the HSE or local council office if HSE don't cover your site. If you can do, contact your branch Union Office and get your Area Safety Rep to do a risk assessment of the area in which the accident happened and make sure to include in the risk assessment ALL changes that have been made since the accident occurred.
