went to work this morning an had a fact finding interveiw an told im suspended until further investigation i have been home before my offical finishing time but when all the post is delivered what am i suppose to do also acused of claim 1 hr overtime when car seen at my home please can any one help will i get the sack for frauld for claiming ot help needed

First off they need proof, not 'he said, she said' proof from the Manager but real hard proof. Do you think they have this?

If they are trying to bring you in for finishing before your time then that needs to be the case for the whole office, not just you.

The thing that concerns me though is that suspensions are only brought in if they think you will be a security risk whilst they undertake the result of the fact finding interview. Or at least that should be the case.

yes they can sack you for 'false accounting' or 'fraud' but again only if their case is watertight, if not they will lose in any future tribunal.

11 PRECAUTIONARY SUSPENSION FROM DUTY There are circumstances in which it is necessary to suspend an employee from duty. The main reasons to justify suspensions include:

· Suspected, alleged or admitted dishonesty
· Drunkenness/being under the influence of non-prescribed drugs
· Refusal to obey a reasonable instruction
· Violent or abusive behaviour
· Alleged wilful delay of the mail

Suspension should only occur when it is necessary to prevent the risk of further breaches of conduct, to protect employees, property or mail, or to protect Royal Mail's good image and standing in the community. It should only last as long as is genuinely necessary and will be reviewed after 48 hours and at reasonable periods thereafter.

Precautionary suspension will normally be with pay but not so in cases of drunkenness, being under the influence of non-prescribed drugs, refusal to obey a reasonable instruction, violent or abusive behaviour and in cases of admitted dishonesty. In cases of suspension of employees facing criminal charges the initial suspension will be with pay.

This will be reviewed after 48 hours and as information comes to notice a decision will be taken as to whether pay should continue. The decision as to whether pay should be stopped will only be made following careful consideration and consultation with Personnel. On any occasion where pay is stopped notice will immediately be given in writing to the employee with a statement of the reasons for stopping pay.

i was folled by both bosses an they said the issue is me signing in at 10am finish at 2pm but sitting at home at 12.56 they have followed me for a month an say ive falsly claimed overtime as im on a walking duty will i be a gonna can then sniff around your house

i know ive been snitched on by a work colleage but he also claims overtime aswell i got acused this morning also about not delivering all sky mags but it was my long wkend off when will they be in touch with me to let me know if im sacked or still have a job im at my wits end with worry

say your car was at home because you dont use it on your delivery and you never drove it to work.

Well I think if you have been claiming overtime and you are not due it then you probably are a gonner. But It's a different matter if it's within your contracted hours. Only you know either way.

Take in the above to them and tell them to put you back on delivery immediately or you will submit a harassment compliant form.

Also if you were leving the office with only 3hrs left of shift and so booked 1hr to make it up to the standard 4hr del time (incl travel) then you are doing no wrong. Tell them it's job and finish and you were working faster than required to complete and claiming only for the time the duty has been designed for. Tell them the alternative was for you to work at the correct speed but have to cut off everyday. How do they know the OT you claimed for wasn't for 2 days before when u went over by 2hrs?

Tell them if they sack you you'll go to an employment tribunal for being treated differently to others. First thing you need to do is make them realise you know your rights and going in with their rules on suspension which they are breeching is the first step.

if you have claimed an hours overtime that you didnt work,then quite rightly you should be drop kicked out of a job.no ifs, no buts.
but if you somehow mananged to finish early and they have no more work for you then you are entitled to go home.but if you do in our office they will make sure you work extra the next day for nowt.

but as i say,if you went home early and booked over time then you deserve everything you get.lets hope you didnt do that.

as for its only an hour.we had a guy sack for booking 10 minutes more than he worked.
they didnt even ask if he had taken his break,which he hadnt ,and got a nice award from the tribuneral,and reinstatement .
he didnt bother to come back in the end.and after 3 years royal mail still havnt paid up.
i said he should get a court order for payment
then get the baliffs in..seize all the bikes.lmfao..
