My point is, where does a non union member stand if they don't cross the picket line? Could they face disciplinary action and would the union fight their corner?

Royal Mail employs you not the CWU, unfortunately without a good cause disciplinary action could be taken against any non union members as Royal Mail have knowledge who is a union member and who is not.
Any non union member will not get any support from the CWU i.e to quote you (to fight their corner)

Thats not true mate, all employees regardless of whether or not they are the union can strike.

It i illegal for any company to take action on the basis of someone being a non member.

They are covered by the collective YES vote

Best thing is to see your CWU rep and get joined up, it doesn't cost much, just a couple of quid a week, then you have support and representation should you fall foul of management which is all too easy to do these days, be it re attendance proceedure or conduct code et al. Then in event of industrial action you won't have to worry, good luck bro. :wave :wave :mfo :cfo

Industrial action by workers who are not trade union members

If you take part in industrial action when you are not a trade union member you are normally treated as taking part in unofficial action. This means that if you are dismissed while taking part in the action you normally have no right to complain of unfair dismissal.

You can still claim if the reason for your dismissal was automatically unfair.

You are treated as taking part in official action if both:

* members of a trade union are taking part in it
* the action is official industrial action taken by their trade union

This means that the law treats you in the same way as it treats trade union members. Your rights if you are dismissed depend on whether the industrial action is protected or unprotected and when you are dismissed.

I have been told by a few people that the Delivery Sector Manager for the Stockport area was threatening to suspend any non union member who stays out during the strikes.

See my above post - he would loose any tribunal sought by any employee he suspended. Once the action is declared official and legal anyone, whether in the Union or not, can join the strike and cannot be singled out just because they are non union employees. Simples.

If an employee is not a union member and withdraws there labour in support of the breakdown of industrial action relations between its employer and the union supporting its members, then legally no disipline can be directed towards them because of this!! is that what your saying?

I would have persumed they would have had to turn up for work as normal because the relations breakdown between the two party's does not effect any non union member and therefore the business would have grounds to disapline under the attendance procedure.

No, you won't face disciplinary action for not crossing a picket line, and if you want the added insurance of the CWU fighting your corner should management decide to break the law, then join the CWU.

This page will clarify it. Anyone can take part in legal IA even if not a Union member, however they can face the same consequences.
