Firstly, 30 minutes flex is voluntary as it is needs to fit in with your day, i.e. collecting children from babysitter, appointments etc as per the 'Variation in Hours' section in the agreement.

Secondly, the banking/annualising of hours is part of Phase 4 .. which has not been discussed let alone agreed with the CWU!

Your total weekly contracted hours are 40, if employed full-time .. any requested 30 minutes in addition to those contracted hours have to be 'flexed' back within the 40-hour week period, not a 5-, 6- or 7-day period as some DIM DOMS like to think, or paid as overtime.

The below paragraphs are taken from the 2007-2009 Pay and Modernisation Agreement

Variation of hours - Where necessary, for example when traffic volumes are unexpectedly high or resourcing issues arise, individuals may be asked and may themselves request to vary their duty times by up to 30 minutes on a swings and roundabouts basis. Again, individual circumstances will be taken into account and total weekly contractual hours would not change

1. One could argue that 'unexpectedly high' is not relevant as we know that we are going to be hammered by mail as a result of the action.
2. Asking is a request, not a demand, and individual circumstances also require taking into account.
3. Naturally, the total weekly contractual hours do not allow for flexing on a Saturday as it would exceed the total weekly contracted hours of 40 hours.

Phase 4 : Joint Working Group 2 - New Reward Framework ... It will also review annualised hours or banked hours, flexible working, and possible changes to attendance patterns that could both benefit the business and employees and is in line with the company's family-friendly policy .....

Any implementation of 'banked hours' is not enforceable as it has not even reached the review stage, let alone agreed between RM and CWU. The time frame for discussion and agreement over the various Joint Working Groups was January 2008 - April 2008 as I recall.
