Non Union Strikers

Some lads in our office are not in the union, (I am in it before you add your funny comments ) what usually happens is we go on strike but they have come in to work. Coz ours is a small rural office we dont get any mail from the main sorting offices when the strikes are on or very little mail. The lads do this and go home hardly having done any work at all. After a while the managers cotton on to this and ask them to go a main office and and do the work there. The RM would provide transport. The lads have said in the past they will not cross a picket line and have usually got away with having to go.

This time Im not so sure for them, Ive told them they could be made to go or they could be on unofficial strike action. Is this right?

Some say they will ask if RM can "vouch for their safety" when crossing picket lines, working in other offices and delivering on other patches, saying they know RM mangement will say they cant, so they will refuse to go.

One lad said in conversation about the stuff thats going on that the only thing "we" can do is strike then, that lad isnt in the union though, he thought or thinks he can strike with the rest of us. Can he?

What can you tell is the ruling on these matters? I know these lads would hate to have to go to other offices to break other pickets but or obviously open to RM pressure, maybe loss of job for not doing as asked.

All employees regardless of whether they are in the union are not will be able to strike and will be protected by law as the 'collective' unit has been balloted

Read and make sure you understand the implications but the most important part is this:


Industrial action by workers who are not trade union members

If you take part in industrial action when you are not a trade union member you are normally treated as taking part in unofficial action. This means that if you are dismissed while taking part in the action you normally have no right to complain of unfair dismissal.

You can still claim if the reason for your dismissal was automatically unfair.

You are treated as taking part in official action if both:

* members of a trade union are taking part in it
* the action is official industrial action taken by their trade union

This means that the law treats you in the same way as it treats trade union members. Your rights if you are dismissed depend on whether the industrial action is protected or unprotected and when you are dismissed.

its £2 a week for gods sake even the part timers are joining now there 3 month contracts are coming to an end, it shouldnt just be that we may be on strike soon that they wanna join the union, it amazing how many come up to me when they are in the s**t asking for help and advice yet dont wanna stump up £2 to help pay for the training and resources that have put myself and fellow reps in a position to help.

Just because someone isn't in the Union it doesn't mean it's ok for them to go into work, as they're no more obliged to do so than anyone else is. You are damaging the effort that everyone else is putting in, and taking any benefits earned whilst sacrificing nothing.

There wouldn't be this problem if there was a closed shop.
I was on strike two years ago even though I hadn't had a chance to join the union before the strikes started.

Your not on strike just taking a day off! You just hope to gain from US! Your not stupid and have NO excuse but thats OK to me as long as you dont cross the picket line! But please spair us your excuses and yet again may all who shair your views enjoy that that we believe in and pay for, enjoy the extra PROFIT in your pocket and i think thats some 2 to 3 quid a week (and no i dont know my subs a week i dont count because "I" am part of a Union!

I don't get paid whilst i'm on strike either. Would you rather I went into work because i'm not in the CWU, instead of supporting everyone else?

I paid CWU subs for 10 years - I resigned when they made a complete bollocks up of the 2 biggest agreements they ever needed to get right, and now we're paying the price.
