I finally got my arse into gear today and completed both an CWU LS3 form and a DWP Industrial Injury Claim form for my AOD. Anyone know the procedure and time scale for these forms, weeks or months?

I think the DSS form, B195, has 3 years, but don't quote me! Sent it in with "supporting info". Put my second one in yesterday, for 4th dog attack in less than a year, plus supporting info again.
First one took about 2 months, and got affirmative letter to support my claim.
So, awaiting similar outcome hopefully...

These form should be filled out a.s.a.p,but ive known of cases where they have been completed a year after the incident took place,it could be even longer,im not sure.

Can i ask what a 'DWP Industrial Injury Claim form' is?
I have given out the LS3 forms before but not this one.

The union advised me to get a DWP Industrial Injury Form. On the front page it says ' This form is for declaring an industrial accident and claiming Industrial Injuries Disablement Benefit for an accident at work.' I don't really know much else about it, sent it off this morning so will let you know whats what when they get in touch.

Found out today that the managers have lost my Accident Report, even though it was done via ERICA, will this make any difference to the claim I have put in?

Me thinks that management may be trying to pull the wool over your eyes. As you have already stated your Accident Report was done via ERICA. For why, you may ask! As part of the completion procedures for ERICA the box headed "Paperwork Compliance" was amended to read "

(i) Print out two copies. (ii) Store one in the ERICA Folder. (iii) You must immediately send a copy of the incident report to the Union Safety Representative in good time. (In this regard the USR would be deemed or classed as the CWU Area H&S Rep and not the Workplace/Unit H&S Rep).

More importantly you should note the following:

ERICA Handbook:
An "ERICA Handbook" has been constructed which will be issued to all Managers and Offices. However, CWU wanted a number of significant amendments to the Handbooks and Managers Guidance. (From memory there turned out to be about 18 or so amendments that were finally agreed upon).

Local Records - The CWU raised concerns regarding the need to retain local records for Inspection, audit, compliance and enforcement purposes.

This specific issue was resolved as follows - A locally retained "ERICA Record Book" will be maintained on every site. This will consist of a sectioned Ring Binder in which Managers will file the various incidents by type in each section and the book will be subject to Audit and Inspection by Trade Union Safety Representatives, auditors or HSE/LA Inspectors.

I would be asking management with the assistance of your CWU Area H&S Rep some rather forthright and impertinent questions as to how Data Protected Information was lost. I wouldn't at all be surprised if they can recall your information from the system and do another print off!

As I see it:
1. A copy may have ineed been retained in the local "ERICA Record Book" and they are telling you porkies.
2. They may indeed have cocked up badly and failed to file a copy for audit and inspection purposes which they are required to do.
3. They may to have not immediately forwarded a copy of the incident report to the Union Safety Representative (Area Safety Rep) which again they are required to do.
4. They may have failed to file a copy but sent the ASR a copy (if this is the case discussions via your ASR will confirm this).

Information from ERICA is fed into a sequential database. All the data will be stored there.

Advice sought from the CSR Helpdesk revealed the following:
With regards to the ERICA Folder, this must be kept in a secure location,
as it contains personal information, some of which can be classed as
"Sensitive" under the Data Protection Act 1998.

A secure location would be deemed as a lockable cupboard or safe, an office
that people have regular access to would not be classed as such.

The DWP will send you to see a Doctor who will assess you then make a judgement as to whether or not you will be permanently disabled or to how long it will take for you to recover from your injury.
They will also make an assessment as to what Percentage you are disabled and if it's over a certain criteria will pay you a weekly amount based on the percentage awarded,either for life or for the time they think it will take
for you to recover.

May i also point out that if you are given an award by the DWP that says you will have a disability for life and the percentage is over 15% (i Think ) then you can make a claim as well from the CWU insurance scheme
which will pay you a one off payment of (i think ) £500 per percentage point you are awarded.

The one thing i find strange about all this is that RM will claim back any payments you receive from DWP from any compensation you are awarded for your AOD.

Good Luck but be prepared to wait a long time for your claim with RM to be settled.

So...reading all of this, I have to ensure, on my return from AOD:
1. ERICA has been done - which I believe mine was, but no copy was ever given to me to sign - and a copy sent to my Reg. CWU Rep?
And...a copy has been forwarded, correctly as mentioned.

2. A "Dog attack" compensation form has to be given to me, or at least completed electronically in my presence?

3. Atos have supplied an acceptable/reasonable Re-hab programme/schedule? ( Been No Atos contact after 5 requests.) Anyway I can get them "fully" involved? Tried direct calls, refused any info.

4. Have I missed anything of importance/outstanding?

Be prepared for anything! I had an AOD a while back, and was given a copy of the ERICA to sign. There was also a section, which the Manager signed, to say that he'd completed his investigation into the accident (although I wasn't given a copy of the Accident Investigation). A couple of Months later, I was told that he'd just completed his investigation into the accident. And that I was found to be negligent, and completely at fault for the accident.

I can't go into any more detail, as it's an on-going case. But please bear in mind, that this is the type of thing that could happen to you. Particularly as you're putting a claim in.
