We have someone in our office who came in to do a part delivery this morning, but he is down as being on A/L this week! Surely this is illegal?
Personally I think he's an idiot for doing this, and he's not a newbie. He's got over 15 years service in. Talk about showing the managers the way! He'll put Crozier out of a job lol!
And even when they became discontented, their discontent led nowhere, because, being without general ideas, they could only focus it on petty specific grievances. The larger evils invariably escaped their notice.

I may be wrong here but this is not allowed to happen at our office and hopefully not allowed at other offices.
This is from the Way Forward agreement which i believe still holds the field.

Taking Leave

Employees may not attend the office whilst on annual or other leave. This means that employees may not attend the office to work overtime or Scheduled Attendance.



Your branch may be breaking a national agreement by allowing this to happen :sad:

This often happens in our office.
Whats the problem??

It's us, the CWU members that are benefiting from the extra earnings!!

Thanks for your replies. No worry Johnnyp, it's not our branch policy. As far as I'm aware, the individual concerned does deals with the local dom. I will be taking this up with the branch officials however.
To Poptart: losing out is not the issue here. If this is allowed to carry on then who knows where we could end up: People forced to give up A/L at short notice perhaps?

I have always understood and indeed it is our area policy that it is NOT agreed to work annual leave if a member agrees to come in whilst on annual leave they should take that day another time. Before we know it we will be told if you want to work it, why not lose a few weeks you obviously get too much leave! :arrrghhh

I became rep a while ago and brought his practice up. I was, however, dissuaded from taking it further by the branch as it is our members who would be made to suffer and it's them (like reps too) who pay their cwu subs.

Having said this I've not heard of people being forced to work their a/l off and if I did then I'd take it further.

so then if they have an accident on duty time but its been done on overtime thats illegal how do they stand errrrm they havent leg to stand on

It does however bring up one question. What other organisation would have to even make Overtime available whilst your on leave. It certainly should highlight the fact that the cuts have gone too deep if its a regular occurrence.

I'd have thought, like staff starting early, that they'd be covered should an occurrence happen. Having said that, I'd be happy to be proved wrong.

Actually they shouldn't be working they won't be insured. If a accident happens RM won't be responsible. So, if he works and has a accident it will be his fault.
And I think RM shouldn't be allowing it.

its ok the dom saying yes in writing but nope he is not insured its a holiday that the law says you must have

If you are working you are covered by the employers liability insurance

the law does not state anywhere that you must have a holiday, it does state however that you must be able to take a holiday but does not state that it is compulsory for you to take it, only that it is compulsory for your company to give you the opertunity to take it
