Driving allowance after transfer.

Hi I am just after some solid info on this.Can anyone tell me if I am entitled to driving allowance,I tranfered 5 years ago from a large del office to a small rural office,i was getting paid 600 allowance till they asked for it back.I dont mind paying it back but the union seem to think I am entitled to £6.00 a week,the management say im not.The union say i am because I was continually driving,the managment say no because it was a voluntary transfer.So obviously someones lying to me but who.

you had to be a driver before ( i cant remember the date but its more than 5 years ago) anyone coming on to or driving wasnt entitled to driving allowances but grandfather rights is a good shout but they might come back with its only for 3 years

i seem to remember in the way forward deal it stated if you change duty you would lose allowance
maybe i dont remember right

I think if you got the allowance before the cut off date you kept it while you continue on the duty assigned it but if you move off it and it's your choice you lose it. When we had an office repick the drivers duties that were entitled to allowances were ringfenced so they wouldn't end up paying the allowance to two people ie. the new duty holder and the person who could have lost their duty in a repick and it wasn't their own choice. I don't think you will be entitled to it and it's best to get it sorted quickly and correctly because myself and a few others in our office ended having to pay back about 6 months worth of driving allowances when they realised they had payed us it in error.

Well, this is what The way Forward Agreement says:

DRIVING ALLOWANCE

The new package will retain non-pensionable assigned allowances as personal reserved rights for the following employees:

· £6.00 per week (pro-rata to conditioned hours) for employees graded PMN/women, who are not receiving another assigned non-shift allowance, and whose substantive job on the 31 January 2000 involves driving a Royal Mail van (of less than 3.5 tonnes) for at least two conditioned hours per day. This will include reserve jobs dedicated to covering driving duties as of 31 January 2000;

· £6.00 per week (pro-rata to conditioned hours) for employees graded PMN/women or Streamline Level 4, who are not receiving another assigned non-shift allowance nor the £6.00 for van driving, and whose substantive job on 31 January 2000 involves driving a fork-lift truck for at least two conditioned hours per day. This will include reserve jobs dedicated to covering fork-lift duties as of 31 January 2000;

These allowances will be frozen and retained on a personal rights bases by these employees only so long as they remain in the same job as on 31 January 2000. There will be no payments for hours worked on overtime or Scheduled Attendance. These assigned allowances will continue to be paid during annual leave and other paid absence. Employees on rotations as of 31 January 2000 will receive an average payment.


Although, in practice. When you're moved off a Duty, and it isn't your choice. You get to keep the allowance. At least, that's what's happened until now, anyway.

1.3 Early shift allowances in delivery retained as grandfather rights (for those in receipt since April 2007), including those in receipt of equivalent MTSF payments for changes made since May 2005. We will agree how this money, and equivalent MTSF payments for early shifts, may be used going forward as part of the pay restructuring process in Joint Working Group 2 – if no satisfactory solution is found then grandfather rights will be retained. The early shift payment is ceased in delivery on agreement to pay restructuring.
