Dismissed even when Royal Mail were paid for my absence :oI

I was dismiss/sacked even though monies were paid for the time i had off sick due to a road traffice accident. Some other members of staff have had their warning taken off but mine were not even after evidance was given. Is this fair?

Get advice for Tribunal if you were in a RTA pretty serious stuff & they were paid presumably by the third party insurers & you were still sacked that is a joke, but to be honest not abit surprised with RM,have you worked for them for over a year if not you really have not got a case,unfair dismissal can only be pursued after one year, speak to your area rep he/she will know more than your office rep.Good luck P.S you still have your internal appeal you must get that in within 3 days of being sacked, but I would'nt hold out much hope for the appeal system.

if under a year - you MAY ? have a " unfair detriment for H&S " issues tribunal case - RM internal appeals are just to wear people down but you have to go through with them so you can't be made out to be a " troublemaker " .

Obviously a AM or similar wanted rid of you ? as you'd lost too many hours - beancounters !

The only other alternative if less than one year's service is shopping RM to one of those women's magazines , that is a point ? but the danger is that it could make some look like a "unemployable troublemaker" , possible damage to RM's corporate image ? & RM would [/b]soon buckle - as for the OSA , is it really a security issue ? , at one there was some good will , you didn't " kiss and tell " about RM & vice versa , the union in the main was against Industrial Tribunals ; it was only a emergency last resort as it dragged everybody and everything down in the service through the mud .

Now that's all changed .

Thank you for your reply.. I have worked for Royal Mail for 13 years and my Third Stage was given because the manager asked me to come to work as a trial period but it was too much for me, therefore i went off work again, i was under phycio and found out later that the pain was due to my spine. I did go back to work and after 1 month of working they dismissed me under the attendance stage 3, however all the monies were paid back to them. There are other workers at Royal Mail that when the monies were paid back their warning were taken off, all i am have been told by the manager that "it is the managers discrestion". I think i have been unfairly treated, Im a very quite person, therefore i think they took advantage of that as they just wnated to get rid of people.

If the RM internal appeal fails which it probably will , as RM will be more concerned with closing ranks and protecting their managers and hoping people will go quietly & not give them a problem , there will be all sorts of bullying ( be it subtle or verbal even ) by RM right up to the Tribunal date - Kay will certainly vouch for RM's underhand machinations !

As for managers using discretion or initiative :left : - everything is to a foregone conclusion and is purely to impress a more senior manager , RM will say that everybody has to sing from the same hymn sheet which is the corporate way , the problems are that style of management is very regimented and things get taken to extremes and are handled badly .
