Conduct code outcome - appeal
Hi, I have just been informed the outcome of my conduct code case - I won't go into any detail but all my fellow workers and CWU rep cannot believe how harsh the penalty is(not losing my job). I've been informed that i have a right to appeal but since this will be done by another RM manager from a nearby office I can't really see the point in bothering and feel I would be better off getting on with job and keeping my head down - I mean does anyone really think another manger would be impartiale when he's only a phone call away from the tools in charge of my office?
Basically it looks like they are using my case as a way of making some savings in our office , suprise suprise so no doubt they will be very keen to get the original verdict upheld. I've been with RM for nearly 15 years with no conduct code issues or even a Stage 1 sickness against my name and was wondering if this should be taken into account by any appeal? Has anyone on here ever gained anything by going to appeal and as such is it worthwhile or just prolonging the inevitable?

Id say theres probably no point other than to show your total disagreement with the outcome. If you feel you have been done badly by and the CWU are willing to proceed with the case, then and only if you are wanting to take it beyond RM internal appeal system, would I then take it to the next stage.
What I am trying to say rather badly is - if you want to go to an Employment Tribunal then you will have to exhaust the internal appeal system before you can go any further.
If you are not going to go on to an ET and you are happy, or at least accept the outcome, the I would advise biting the bullet and leave it as it stands.

Yes you should appeal. There is a slight chance that you might get a manager to overturn the original decision although don't hold your breath. I got a 2 year serious and the appeal was rejected but one of our blokes was sacked and then reinstated on appeal. I know RM rarely allows the truth to interfere with anything but you have nothing to lose. GO FOR IT - IT IS YOUR RIGHT !

So if I appeal and the outcome is the same even though I'm not losing my job would I be able to take the case outside of RM? If you are loosing money then I would say yes you are allowed to take to an ET, however the Unions solicitors or an Employment Lawyer would be best to get advice from as they will be able to assess the merits of your case. Once upon CC action went berserk in my D.O appeals were lodged left right and centre and were succesful in reducing or removing the penalty.
I had a 1 year reprimand in 2001 which was overturned on appeal
2004 had a 1 year suspended dismissal didnt appeal, just carried on as usual apart from one slight modifacation and the year zoomed by and ive been clean ever since.
Without details of your case its difficult to say if you determine a good chance at appeal.

Funnily enough 2001 I had just taken over as safety rep and 2004 just taken over as IR rep.

OP, have Royal Mail denoted you? Or have they deducted pay, I was told that this was illegal by my local rep once. But do I believe him...

Appeal thats what i'd do, half the managers are dimwits and don't know about rules and regulations. I really depends on what the conduct code is for, the fact you have posted on here suggests your really miffed, so deep down your going to a appeal.

Well i'm just waiting for the official paperwork then i'm going to appeal - even if I don't get the outcome I want at least I won't be bending over and making it easy for them and my rep seems to think the outcome should be better than what has already been decided becuase he reckons he's never seen such a ridiculous outcome to a case.
