Urgent query/Sabbatical?

Received this in an e-mail,any advice.

my daughter ******* ****** has been employed at ********* sorting office for the last 10 years. 3 years ago she took an educational break to attend Liverpool university, where last month she achieved a B.A.(hons)degree.
The agreement with royal mail was that she could resume her position on completion of her degree(letter given) however she has been refused her job back by a staff resourcing mng. called ****** ******, and told that she can have 2 weeks in august and to apply again in december.Thus her situation is that because she is officially still employed, recieving a blank weekly pay slip, she is unable to claim any social security benifits, so she has no means of support.
Surley this ridiculous situation cannot be just, it apears to me to be farcical.
I live in Bangkok, and am financing my daughter, but am obviously unable to help in any practible way.
your advice add assistance would be much appreciated. Would you kindly inform me of her rights.

If the correspondent's daughter has a commitment to employment ("that she could resume her position on completion of her degree(letter given)") in writing, then a decent solicitor should be able to mince Royal Mail on this, assuming the girl will not be a CWU member and can't use them to fight her cause.

That a target driven / budget obsessed manager in Royal Mail has done this deed is of no surprise. Input from someone in the legal system in the real world will scare the life out of him / her and would be the best road to ***** getting her job back. For the manager, no doubt a promotion for incompetence will follow

Just one thought - I know times are hard but with the way things are, why would anyone with a degree want a job in Royal Mail? It appears to be the worst employer in the land at the moment.

I myself took a career break and spent my time in Thailand looking to live there fulltime which will happen next Tuesday I had loads of problems with how they managed the MTSF(managing the surplus framework) which does cover people on sabatical/career break and they are still classed as being employed and under contract but on no pay and therefore have the same rights as somebody who still working in her office.The trouble with the management and indeed the CWU is that they all have their own version of this and how it is managed in that office.From what you have written if she took a sabatical for 3 years then she has to return to her office after this time and would have to seek permission to extend this period.She should have gave them 3 months notice on her intention to return to her unit and if no suitable job can be found there they have to do a search in another unit to find her a placement and if no job can be found they would have to offer her Voluntary Redundacy.
Again all this is covered in the MTSF and you might be able to find it on a download on this site,it took me over a year to get what i wanted but finally on my way back to LOS next week and if you need any further information PM me and i will try to get an answer for you,

As i've just returned to work at RM after 1 year studying, tell your daughter to seek a good compensation payout. And leave the job. RM are going down the pan, everyone knows it. The union have lost all credibility, job stuffed. Sorry its a negative post but i'm telling it as i see it.
