wilful delay?

so ive finished my duty today and back in the office, (the DOM was away home by this time SHOCK!) and im going in the DOMs office to put d2d sheet in, and notice a concerning sheet on his desk. it was an email leter from a mail centre and that a questionaire test letter had been sent to one of delivery points, and that it should of arrived onsuch and such a date, and it really arrived the next again date. it had my duty number and had name of dutyholder: and the DOM had filled in my name in the space. then the concerning bit is at the bottom. it said to counsell the postperson on delivery that day and to explain that delaying mail is an offence and so on. first, let me say I take out every single bit of mail and very very come back with any missorts etc. Oh and also it wasnt just my walk on these sheets, there was also another 2. although the DOM hasnt said anything to me as of yet, im slightly worried as to what to expect?

Just basic advice:

Assuming your CWU see your rep first thing. When you go into the office to see the DOM take them with you.

Check rest days etc was it you ?

Dont panic there are loads of reasons why this could have failed, you were not caught bringing it back in. We had two failures a while back nothing was ever done about it.

Just tell him what you told us.

Maybe the punter got the date wrong on the form, could be one of many reasons.

And dont EVER admit bringing mail back.

Its possible that you could have miss-delivered it, the recipiant then put it back in the letterbox , it returned the next day and was delivered properly - - - that would mean your were only guilty if miss delivery

Or you brought it back because their was a dog out

theirs a plausible expenation to almost everything

Also be very careful, about admitting you've seen that Email. Personally, I'd suggest telling your Rep about it, and getting your defence ready. But not actually go to your DOM about it. It could be a trick, to see if you're reading private Emails. :hmmmm

I bring back between 10-20 letters each day, all correctly endorsed mostly missorts but some for dogs DOM knows about amount of missorts, as does my rep and as I am always out of time at end of delivery and am delivery only so don't prep not my problem.

it was an e-mail printed off lying on the desk, although I wont let on Ive seen this. I`ll see my rep asap.

I do a different duty every week and find that i deliver to a lot of flats that i need access to. These are known as a :hmmmm controlled access and sometimes you can never get in as they are timed especially after midday. My point is if no resident lets you in your f***** and all you can do is take back the mail and endorse as no access simple theres nothing you can do just do the job properly and you get no hastle.

You actually buzz the residents to let you in? I used to be on a duty with controlled access and doors only open upto 11:30 am, which was fine for the person doing it before me as they were full time and out on delivery by 9, and as i'm pt and out on deliver 11+ if the doors were locked i'd automatically bring it back. After 3 weeks on the duty the housing Ass changed the access until 3pm at the request of the residents as I made a point of telling them why they got no post most days of the week now.

the wording "wilful delay" is in the conduct cose it means deliberate delay of mail (which can result in the sack), now if you didnt deliver letter deliberatly then they got you ,,,,however if you were unable to deliver due to unforseen factors out of your control it can't be "wilful delay" i would'nt worry just wait for them to make fools of themselfs lol,,,,,,if they gona councell you there taking "remedial" approach just take the councelling admit nothing just listen and thank them for there time lol,,, :cuppa

Wilful Delay
Wilful delay of mail is classed as gross misconduct, which if proven could lead to dismissal. The test to determine whether actions may be considered as wilful delay is as follows:

"Deliberate action taken by an employee that causes mail to be delayed is called wilful delay. Where proven, such breaches of conduct can lead to dismissal, even for a first offence; indeed Wilful Delay is a criminal offence and can result in prosecution".

Don't use the Dog one as any non-delivery should be endorsed at a minimum, and in my DO think we are meant to inform the Manager, when, where and why.

Just had to do that myself today, missed 8 calls due to a crazy ass Jack Russell being out on that particular part of the street.

The dog in question is also on my walk log so theres plenty proof.

Hope the other householders who missed getting their mail today have a less than quiet word with the dog owner, all mail endorsed and put back in the box, might not see it again until Monday.
