Where did you get that idea from, of course he's going to be insured at the end of the day he is employed by RM, you sound a bit pi$$ed of about it, why?

There is no reason why someone can't work their day off when on a weeks leave. It is no different to working your day off at any other time.

At the moment FTs walks are being made PT all over the country so at the moment the battle has to be to try and keep the ratio of FTs above 60/40 otherwise no one will ever be made up. If you see a problem as a member of the Union then don't rely completely on your rep, do your bit as well to change things, after all a Unit rep does not get paid anything by the Union, he/she is doing it volunatrily. The only benefit they should get is release time when required and sometimes in my Office even this is hard to get.

Legally I agree with you. Morally I think its a grey area and people should be left to make their own mind up but only if there is no current agreement between the Union and the CWU. However, getting people in to do overtime while on Annual Leave for a whole week raises questions.
1. Is it effecient to record 1 persons hours twice to do the same job. (Ghost overtime in all but name)
2. Why was there no cover for the duty.
3. With lapsing why was there no one else spare to cover the duty.
4. Has the individual been given the chance of choosing between docket pay or leave later on.
5. Just on the money side does it make sense to pay 1 person twice.
6. How will it be recorded on the hours/manpower plan reports (not sure of their proper name).

Legally, an individual MUST take their statutory leave, that is 4 weeks by law. If a company, such as RM, gives you more than 4 weeks leave, then there is no legal reason why you shouldn't work the extra and claim OT for doing so. Whether that's right or wrong is a different debate, but it's the law!!

I asked a ASR now retired if early starters were insured and the answer was that if RM are allowing them on the premises they are insured.

The info, Sovietonion is asking 4 is....can a P/T Van Driver Postie, work while on a 7 day leave, on a Saturday, even though his job is a 5 day mon to fri week. and as 4 working your day off in that week, that cant be ok coz .dont you need to put the hours in to be entitled to have it off.....

I know you can not work on OT while on A/L. I was not suggesting that you can. When you have a week off on A/L five of those days are A/L and the sixth is your rotating day off. There is no reason you can't work the day off the same as you would if you were not an A/L. Obviously if you work a five weeks on with one week off instead of a rotating day off all six of those days will be A/L and you can not come in at all during that week. 1 weeks Annual leave runs the full 7 days regardless of day off. If you were to book leave which included your day(s) off. The day(s) off, wouldn't be taken from your Leave Entitlement. Therefore, the Driver wasn't on leave at the time. Unless of course, the leave he'd booked, continued during the following week.
In other words: If he wasn't due back until the Tuesday (for example), then he was on A/L, and may not have been Insured. But as he was due to resume work on the Monday, and he was due to be off on the Saturday. He should be Insured. At least that's my understanding of the rules.
