Part time seniority problem

Ok, got a bit of a problem, if anyone has any advice or info I'd much appreciate it.

Basically, Im part time. The most senior part timer in the office. However, about 6 months ago the DOM needed to cover a full time driving duty, and he picked a part timer to cover it, who is now being paid 13 hours a week OT to bring him to full time hours to do the duty. I have a medical condition which means I had to surrender my driving license two years ago, so I obviously cant cover a driving duty. The illness is covered by the Disability Descrimination Act.

I was wondering though, is it right for the manager to bring a less senior postie to full time, when I can do everything the manager needs done on the duty, IPS, sorting packets, boxing in duties etc, except drive the van? Fair enough if it was only for a week or so, but this guy has basically been given a full time job, over my head, since Christmas. Is there anything i can do about this? It's really starting to stress me out.

I'm not certain. But I would think that your DOM is within his rights to give the Duty to a less senior PT Postie, because the Duty includes Driving. If on the other hand, you'd been passed over, for a Duty, which didn't previously include driving. Then it would be a completely different situation.

Of course the DOM is within his rights to do this. You haven't got a driving licence so cant meet the duty requirements..

The way forward agreement says:

FILLING OF VACANCIES/JOBS

1.The key requirement is to ensure that all jobs are filled by individuals with the right skills for the job, and that this is done in a way that both takes account of personal preference, suitability and minimises disruption to the customer and employees.

“Seniority will be used to fill the majority of jobs, because the Business recognises the value of employees’ experience and length of service. Those jobs that require more specialist skills have been identified and are listed at Section 15. They will be filled using an objectively-based selection process. The necessary training will be given prior to appointment”.

So unfortunately I would say in this case that as you don't have a driving licence, even though this was caused by a disability covered by the DDA, then he can't select you to fill that vacancy as you no longer have the qualifications/skills to do the duty.

What I think he is doing wrong, but it is happening all over, is that he has not made the duty itself a FT position and therefore made up whoever has been selected into the duty.

It would be wrong if the DOM bypassed you, if you had a licence, for next senior Postie, and picked them to fulfill the duty obligations.

Sadly he is within his rights because you don't have a driving licence, just the same as any other person may not have a licence. I've also heard of drivers being removed from Syknet (Airport) duties because of color blindness
