stage 2 warning

hi folks
just need some info/advice on stage 1/2 warning i am currently on a stage 2 warning for attendance.the first stage warning i got was for some time off i had in one year the problem was (sorry for the graphic info lol) i was passing blood from the back passage in severe pain in my stomach so i took a few days off not much this coupled with a cold or so earlier in the year reulted in a trigger for stage 1.in my interview i said to the dom i had been to the doctors and he had arranged a barium enema and a stomach scan for me and tried to explain other abscences prior to this and the fact that id gone for about 1 and a half years with no time off at all.he told me that he wasnt prepared to make the decision there and then and that he had to consult his manager about it anyway i got the stage 1 warning and his excuse was "i have given you this warning to give a push in the right direction to getting your problems sorted out i.e stomach/bleeding best of it is i had already been to doctors and got scans arranged so there was no pushing in the right direction to do thankfully scans came back clear and i think i may have ibs.after this i got tonsilitus about 4 weeks after my stage 1 warning i went to the doctors feeling really rough and in pain and he told me to stay away from work for a few days and to take prescribed meds,but because of stage 1 not being very old i struggled into work and asked the manager who was on cover if i could change my duty (walking) to a van duty just for the day so it would make a little easier for me.this was met with a bad attitude and basically not very welcoming and as if i was causing him a load of trouble doing this he did agree but after about 45mins i couldnt take the pain any longer and went home.the manangers leaving comments to me where "ill put you down as sick" so that was another string to my attendance bow.i was off for 2 days after this about a month or so later with sickness and diarehorr and i think that triggered the stage 2.i was called in for the interview and i explained that i had tonsillitus and struggled into work and so on and that i just got a stomach bug and that i had had a really bad few months with illness and that i was back to my best and so on.i got the stage 2 anyway and his excuses where "you said you had tonsillitus,tonsillitus dosent last for one day"i struggled on through tonsillitus as i was too scared to have anytime off.i tried my best to overturn his decision with pleas but to no avail.following this the dom took some time off with stress and the new manager took over the form signing and stuff about 3 weeks after having the stage warning i signed it off and i noticed that on the bit where its says "you where issued a stage 2 warning on such a date i.e 12 may 2006 he had altered the date on it too the current date which was almost a month after.sorry this has gone on for so long i just feel very unfairly treated and stitched up.i had my stage 2 in may of this year also i didnt take any rep in with me as i was convinced given the nature of my illness and my very clean record i would not need any

Do you still have your copy of the stage warning previously issued. If so, and you can prove he has altered the date, you have a shout, on more fronts than one.

In terms of the absences, I think it's just bad luck really but there doesn't seem to be any mitigating circumstances as to why the warnings should have been issued. However, there are two points I'd have an issue with:

1: Your line manager is not a Dr and should not be giving you medical advice regarding having tonsillitis for one day and if that is the reason he issued it then he should have sought medical opinion. All absences are considered genuine. If he didn't believe that you were ill then he should have put it down as unauthorised.

2: Changing the date of the warning is definite no no, he has essentially extended the warning period.

Also, as Soviet said, if it was a part-day absence then it shouldn't have been counted. You said you were in the van 45 mins, but how much time in total were you at work? If it was more than an hour then it's a part-day.

You only trigger a stage 1 warnin after 2 absences or a total of 14 days off sick in one year

Its a bit of both.

For trialists it's 2 absences or 7 days in 6 months
for confirmed staff its 4 absences in 14 days in 12 months

Has IBS been diagnosed by your doctor, if so then IBS is covered by DDA and any absence related to it has to be discounted.
