A duty has become vacant, it goes up for signing, a reserve is told he cant sign for it until everyone else has had a chance, he is told he is a reserve and shall remain one by his DOM
SURELY THIS IS NOT RIGHT? I SUGGESTED THE GRIEVANCE PROCEDURE OR GO FOR VICTIMISATION
ANY SUGGESTIONS?
ARE RESIGNING VACANT DUTIES COVERED BY ANY AGREEMENTS? IS SO WHICH?

If the duty is up on the board as a vacancy there is no reason why he cannot apply for it - he may not be successful if the rules of seniority apply but he can still apply.
What if it is a 40 hr duty and the most senior person is only currently on 30hr contract but the second senior is on a 40hr contract? This duty is a rural driving duty and cant be done on less than 40 hr.

At our place seniority for duties goes FT then PT for vacant FT posts (for PT posts its seniority for all included together)

That would be true BUT if the person has a 30 hour contract and has formerly expressed an interest in going FT then he is allowed to apply and should take precedence.
Look it up and have a read it not complicated (although managers can struggle with it at times), why not print the section in the WF for duties and have it on a noticeboard.
