MTSF AGREEMENT
Hello, Royal Mail are bringing nights back into my local office. They got rid of nights about 5 years ago. We had two workers over 50 who still recieve payment protection. Under mtsf do they have to go back on nights in order to still recieve their payment protection. We were told that that part of mtsf had been scrapped. Any ideas anyone?

they only had to go on duty which would attract the most un -social hours allowance, i.e. if no night shift, then late-shift etc, etc.once they had been allocatated a duty, they are entitled to stay on it.surely you dont want some poor guy took of his duty just because nights have been re-installed

No, neither want to go back on nights but it looks like they will be forced to go back under mtsf. We were told previoulsy that the mtsf agreement reagarding being forced in to different hours because of payment protection had been scrapped.

If you are in reciept of a premium payment (shift or driving allowance etc) under the MTSF you are oblige to accept a duty that cost the business the least amount of money without you actually working on the duty you recieve payment for.
therefore if you recieve money as a pro driver on noghts and nights is removed and a pro driving duty is avaliable then you accept the pro driving duty or loose the premium.
So in the instance described if they are still in reciept of night shift premium it is on the basis that they want to work nights and will go back onto nights. if they don't wish to go onto nights then they should forfit the paymnet, otherwise we should all go for nights and not work it but recieve payment.
If i was in their shoes and was told i don't have to work nights but can still take the money i would ask to see the agreement and get it confirmed in writing by the Office Manager and an area rep, because to be honest, it doesn't soud right.
