Bicycles, are in law, carriages (as a consequence of the TAYLOR v GOODWIN judgement in 1879) and should be on the highway not footpaths. Cycling on footways (a pavement at the side of a carriageway) is prohibited by Section 72 of the Highways Act 1835, amended by Section 85(1) of the Local Government Act 1888. Punishable by a FPN (fixed penalty notice) of £30 under Section 51 and schedule 3 of the Road Traffic Offenders Act 1988.

The primary legislation which makes cycling on a footway an offence is Section 72 of the 1835 Highways Act, this provides that a person shall be guilty of an offence if he "shall wilfully ride upon any footpath or causeway by the side of any road made or set apart for the use or accomodation of foot-passengers or shal wilfully lead or drive any carriage of any description upon any such footpath or causeway."

Section 85 of the Local Government Act 1888 extended the definition of 'carriage' to include "bicycles, tricycles, velocipedes and other similar machines." The object of Section 72 Highways Act 1835 was intended not to protect all footpaths, but only footpaths or causeways by the side of a road, and that this is still the case has been ruled in the High Court. The legislation makes no exceptions for small wheeled or children's cycles, so even a child riding on a footway is breaking the law. However, if they are under the age of criminal responsibility they cannot, of course, face prosecution.

On 1st August 1999 new legislation came into force to allow a fixed penalty notice to be served on anyone who is guilty of cycling on a footway.

TYPES OF CLASS 2 SCOOTERS

Legally these scooters can travel up to 6.4kph (4mph) on pavements and are allowed on the road to cross from one side of the road to the other.

TYPES OF CLASS 3 VEHICLES

The main difference between Class 3 and Class 2 vehicles is that Class 3 vehicles tend to be larger and can be used on the roads where they can travel up to 12.8kph (8mph). It is usually possible to drive at 6.4 kph (4mph)and switch to 12.8kph (8mph).

Class 3 vehicle users do not require a driving license but should obey the highway code at all times. This includes complying with relevant eyesight requirements and not driving under the influence of alcohol, drugs etc.

Class 3 vehicles are not allowed on motorways, bicycle tracks or bus/cycle lanes.

Although legally allowed on dual carriageways, this is not recommended.

Speed

Two speed settings, usually changed by a switch.

12.8kph - maximum speed
Permitted only on the road. Not for use on the pavement or footpath.

6.4kph - 4mph maximum speed
Permitted on the pavement or footpath.

Lights/indicators/horn/rear view mirror/rear reflectors
The law requires class 3 vehicles to be fitted with all these features.

Flashing beacon
Optional - can be used when driving on the road to warn other road users of their presence, and must be used if driving on a dual carriageway although this is not recommended.

Insurance is not legally required for any powered vehicle in either category, Class 2 for pavement use or Class 3 for pavement and road use.

It is recommended that the purchaser have at least public liability Insurance, covering accidental damage to other people and property.

As very few pedestrians use footpaths now unless using them as dog toilets, this needs to be reviewed. I see local people driving the few hundred yards to the newsagent rather than walk every day, and most local pavements are devoid of people except at school opening and closing times..

Our local police take a very sensible view which they made clear to us recently - a police officer called in by our manager to give us a short talk on cycle safety at a WTLL session, explained their attitude to us as working cyclists. They WOULD stop and fine us if we were riding in the designated pedestrian precinct (which does have prohibitive signs and has been plagued by kids riding into people) which saved many of us a couple of minutes on the way to our walks.

However, they appreciated the nature of our job and would turn a blind eye to us riding on suburban pavements where we were delivering to the adjoining addresses as long as we were seen to exercise due care where pedestrians were about. This is a wholly sensible solution which we appreciated and to date no one has had or has caused any problems.

Community police talk to us on a daily basis and never question our use of the paved areas to go from point to point on delivery and it helps us to avoid all the careless drivers chatting on their mobiles whilst moving (now there is something that really needs addressing)
